<br /> <br /> <br /> <br /> <br /> <br /> i <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> ORDI,NAINCE vo. 6979 <br /> An ordinance creating Street I:aprovement District No. 1039; defining, the boundaries <br /> <br /> of the district; providing for the improvement of a street within the district by paving. <br /> guttering, and all incidental work in connection therewith; and providing the effective <br /> mate of this ordinance. <br /> <br /> BE IT ORDAINED BY THE MAYOR AND CObNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: <br /> SECTION 1. Street Improvement District No. 1039 in the City of Grand Island, Nebraska, <br /> is hereby created. <br /> <br /> SECTION 2. The boundaries of the district shall be as follows: <br /> Beginning at the junction of the South line of Eleventh Street and the <br /> cast line of Kimball Street, said point also being the Northwest corner <br /> of Lot S, Block 30, Russel Wheeler's Addition; thence proceeding <br /> northerly along an extension of the East line of Kimball Avenue for a• <br /> distance of 40 feet: thence deflecting left in a westerly direction 40 feet <br /> from and parallel to the South line of Eleventh Street for a distance'of <br /> ~ 80 feet; thence deflecting left in a southerly direction along an extension <br /> f w of the hest line of Kimball Avenue for a distance, of 40 feet; thence deflecting <br /> cv - ~ight in a westerly direction along the South line of Eleventh Street for a <br /> r' Of distance of 132 feet; thence deflecting left in a southerly direction 132 <br /> CL feet from and parallel to the west lire of Kimball Avenue for a distance of <br /> 01 c12 w 280 feet; thence deflecting left in an easterly direction alone the North line <br /> > of Tenth Street for a distance of 132 feet; thence deflecting right in a <br /> W <br /> ~ < southerly direction along an extension of the West line of Kimball Avenue for <br /> o. 0 a distance of 40 feet; thence deflecting left in an easterly direction 40 feet <br /> from and parallel to the worth line of Tenth Street for a distance of 8C feet; <br /> thence deflecting left in a northerly direction along an extension of the <br /> East line of Kimball Avenue for a distance of 40 feet; thence deflecting <br /> right in an easterly direction along the t:orth line of Tenth Street for a <br /> distance of 132 feet; thence deflecting left in a northerly direction 132 <br /> feet from and parallel to the east line of Kimball Avenue for a distance of <br /> 280 feet; thence deflecting lef in a westerly direction along_ the South line <br /> of Eleventh Street for a distance of 3.32 feet to the point of beginning, all <br /> as shown on the plat marked Exhibit "A" attached hereto and incorporated <br /> herein by reference. <br /> SECTION 3. The following street in the district shall be improved by paving, curbing. <br /> „uttering, and all incidental work in connection therewith: <br /> Kimball Avenue from Tenth Street to Eleventh Street. <br /> Said improvements shall be made in accordance with glans and specifications prepared by <br /> the engineer for the City and approved by the Mayor and Council. <br /> SECTION 4. The improvements shall be made at public cost, but the cost thereoc, <br /> excluding intersections, shall be assessed upon the lots and lands in the district soccially <br /> benefited thereby, as provided by law. <br /> SECT1):; 5. This orj_.ill be in force and take effect from and after its <br /> passage, approval, and publication, without the plat, as provided by law. <br /> SECTION 6. This ordinance, with the plat, is hereby directed to be filed in the <br /> office of the Register of Deeds, Hall County, Nebraska. <br /> SECTION 7. After passage, approval, and publication of this ordinance, notice of <br /> the creation of said district shall be published in the Grand Island Daily Independent, <br /> a legal newspaper published and of general circulation in said City, as provided by law. <br /> Eaacted <br /> ATTEST: City Clerk <br />
