That he is a Vice President of Mortgage Electronic Registration Systems, Inc. and a <br />Vice President of Flagstar Bank, FSB. <br />2. There was a scrivener's error in Assignment and Substitution of Trustee documents <br />prepared for signature referencing a Deed of Trust wherein Allison M. Lavelle and Ryan N. <br />Lavelle were Trustors, Mortgage Electronic Registration Systems, Inc. is named Beneficiary and <br />Old Republic National Title Insurance Company is named Trustee ("Deed of Trust"). Said Deed <br />of Trust was filed for record on May 18, 2007 as Instrument No. 2007-04069 in the records of <br />the Register of Deeds of Hall County, Nebraska, conveying the property ("Property") legally <br />described as: Lot One (1) and the Northerly Forty (N40) feet of Lot Two (2), Block 2 in Fifth <br />Addition to the town of Cairo, Hall County, Nebraska ("Property"). <br />3. The scrivener's error incorrectly named the entity of "BAC Home Loans Servicing, <br />LP" instead of "Flagstar Bank, FSB" on the Assignment filed on June 16, 2009 as Instrument # <br />0200904823 in the Hall County Register of Deeds office and the Substitution of Trustee filed on <br />June 16, 2009 as Instrument # 0200904824 in the Hall County Register of Deeds office. <br />4. That at no time did BAC Home Loans Servicing, LP hold any lien or other interest, <br />or any right or title to the Property or Deed of Trust, and at all times relevant hereto Mortgage <br />
