<br /> SPECIAL WARRANTY DEED
<br />
<br /> 1. The City of Grand Island, Nebraska, by action of its
<br /> City Council on November 21., 1933, enacted Ordinance No. 6961,
<br /> which directed the conveyance of the real estate described below
<br /> and the manner and terms thereof.
<br /> 2. Ordinance No. 6961 was published in the Grand Island
<br /> Daily Independent according to law, and notice of such sale and
<br /> the terms th.2reof were published in, the Grand Island Daily
<br /> Independent for three successive weeks, on November 29, December 6,
<br /> and December 13, 1983, all as required by Section 16-202, R.R.S.
<br /> 1943.
<br />
<br /> 3. No remonstrance against such sale was filed with the
<br /> City Council of the City of Grand Island, Nebraska, within thirty
<br /> days of the passage and publication of Ordinance No. 6961.
<br /> 4. Section 5 of Ordinance No. 6961 provides that if no
<br /> remonstrance be filed against such conveyance, the Mayor and City
<br /> Clerk shall make, execute and deliver to the Grantee, a Special
<br /> Warranty Deed for said real estate, and the execution of such
<br /> deed is hereby authorized without further action on behalf of
<br /> the City Council.
<br /> NOW, THEREFORE, the City of Grand Island, Nebraska, a
<br /> municipal corporation in Hall County, Nebraska, as Grantor, in
<br /> consideration of One Dollar ($1.00) received from Grantees, does
<br /> hereby grant, bargain, sell, convey, and confirm unto
<br /> STEPHEN JOE MIRANDA and CECILIA MIRANDA,
<br />
<br /> husband and wife, herein called the Grantees, the following
<br /> described real property in Hall County, Nebraska:
<br />
<br /> Lot One (1), Block Twenty-nine (29), Ori.Ri,.nal
<br /> Tom, now City of Grand Island, Hall County,
<br /> Nebraska,
<br /> hereinafter referred to as the Premises.
<br />
<br /> To have and to hold the above described Premises unto the
<br /> Grantees and to Grantees' heirs, devisees, executors, adminis-
<br /> trators, successors, and assigns forever, so long as the Grantee
<br /> performs all of the covenants and obligations contained in para--
<br /> graph 6 of the "Agreement for Purchase of Real Estate" recorded
<br /> as Document No. 83-006104 in the office of the Register of Deeds
<br /> of Hall County, Nebraska.
<br /> This Special Warranty Deed shall convey to Grantees an estate
<br /> in fee simple determinable, and in the event of breach of any of
<br /> the provisions of paragraph 6 of the foregoing Agreement for
<br /> Purchase of Real EstaL'e, the possibility of reverter shall vest
<br /> in the Grantor herein, the City of Grand Island, Nebraska.
<br /> Grantor hereby covenants with Grantees and with Grantees'
<br /> heirs, devisees, executors, administrators, successors, and
<br /> assigns that Grantor is lawfully seized of said Premises; that
<br /> they are free from encumbrance, except for the foregoing, conditions,
<br /> easements and restrictions of record; that Grantor has good riht
<br /> and lawful authority to convey the same, subject to foregoing
<br /> conditions; and that Grantor warrants and will defend the title
<br /> to said Premises against the lawful claims of all persons whomsoever.
