200500771 <br />ORDINANCE NO. 3 (5— <br />AN ORDINANCE VACATING A PORTION OF THE FRONTAGE ROAD ADJACENT <br />TO UNION STATION SUBDIVISION AND SCHLEICHARDT SUBDIVISION; <br />CONTINGENCY; RESERVATION OF TEMPORARY EASEMENT; REPEAL OF <br />ORDINANCES IN CONFLICT; EFFECTIVE DATE. <br />BE IT ORDAINED by the Chairman and Board of Trustees of the <br />Village of Doniphan, Hall County, Nebraska: <br />Section 1. VACATION OF FRONTAGE ROAD. That portion of the <br />Frontage Road adjacent to Union Station Subdivision and <br />Schleichardt Subdivision and legally defined as follows, is hereby <br />vacated subject to Section 2 and Section 3 of this Ordinance, to- <br />wit: <br />Commencing at the Northeast corner of Lot Two (2) of the <br />Union Station Subdivision East a distance of Forty and <br />Three Tenths Feet (40.31), thence South a distance of <br />Three Hundred Twenty -Seven Feet (3271), thence West a <br />distance of Forty and Three Tenths Feet (40.31), thence <br />North a distance of Three hundred Twenty -Seven Feet <br />(3271) to the point of beginning. <br />All right, title and interest to said property shall revert to the <br />abutting property owners, one half on each side thereof, and become <br />a part of such property. <br />Section 2. RESERVATION OF TEMPORARY EASEMENT. The vacation <br />of the foregoing Frontage Road shall be subject to an easement in <br />favor of the Village of Doniphan and its residents to use said land <br />for street purposes until June 30, 1996 or until a new road is <br />constructed upon the following described real estate, to -wit: <br />Commencing at a point Three Hundred Thirty Seven Feet <br />(3371) South of the Northeast corner of Lot Two of Union <br />Station Subdivision, thence South a distance of Two <br />Hundred Twenty Feet (220') , thence West a distance of One <br />Hundred Five Feet (105') to the eastern edge of First <br />Street, thence North a distance of Two Hundred Twenty <br />Feet (2201) along the eastern line of First Street, <br />thence East a distance of One Hundred Five Feet (105') to <br />the point of beginning. <br />whichever is earlier. <br />Section 3. CONTINGENT ON TRANSFER OF REAL ESTATE. The <br />vacation that portion of the Frontage Road described in Section 1 <br />is contingent and conditioned upon the transfer of title to the <br />
