I am the duly elected and acting Mayor of the City of Grand Island and provide this affidavit in my official capacity as Mayor. 2. By Special Warranty Deed dated April 22, 1985 and fled of record May 9, 1985 in the office of the Register of Deeds of Hall County, Nebraska, the City of Grand Island conveyed certain real property, as more particularly described on Exhibit A attached hereto and incorporated herein by this reference, to Timothy O'Neill, Thomas O'Neill, and Joseph O'Neill (the "Grantees ") (the "Special Warranty Deed").* $ .6— 6t d % 3. The Special Warranty Deed reserved unto the City of Grand Island a possibility of reverter, in the event certain subsequent conditions were not performed by the Grantees. 4. As required by the Special Warranty Deed, the Director of the Community Development Agency has certified that all conditions required of the Grantees by the Special Warranty Deed have been satisfied. 5. By this Affidavit, the City of Grand Island acknowledges the right of reverter has been extinguished and, to the extent required, releases any and all rights of reverter it has or may claim to have arising from the Special Warranty Deed.
