NEELEY, a single person, Grantor, in lieu of foreclosure, conveys unto FARMERS <br />STATE BANK, A BRANCH OF BANK OF CLARKS Grantee, the following described real estate as defined in S <br />Nebraska Revised Statutes Section 76 -201: <br />Lots 7, 8 and 9, in Block 21, MacColl and LeFlang's Addition to the Village of Wood River, Hall <br />County, Nebraska, <br />together with all buildings, improvements, fixtures, and appurtenances located thereon. <br />Grantor covenants with Grantee that Grantor is lawfully seized of such real estate and that the real estate is <br />free from encumbrance, except encumbrances of record; has legal power and lawful authority to convey the real <br />estate. <br />Non - Merger. Grantor and Grantee acknowledge and agree that this Deed in Lieu of Foreclosure does not <br />merge the fee simple title of the real estate with the lienhold interest of Farmers State Bank by reason of a Deed of <br />Trust recorded as instrument number 0200108052, at the office of the Register of Deeds of Hall County, Nebraska, <br />on August 10, 2001.
