200500497 <br />THIS AMENDED DECLARATION made on the date hereinafter set <br />forth, by Park Gardens Home Owners Association, Inc., <br />hereinafter referred to as "Declarant ", comprising of the <br />owners of all the following described real estate, to -wit: <br />Lots 1 thru 8 of Park Gardens 2nd Subdivision <br />Lots 1 thru 3 of Park Gardens 3rd Subdivision <br />Lots 1 thru 3 of Park Gardens 4th Subdivision <br />Lots 1 thru 8 of Park Gardens 5th Subdivision <br />All in the City of Grand Island, Hall County, Nebraska, <br />WITNESSETH: <br />WHEREAS, Declarant is desirous of providing easements, <br />restrictions, covenants, and conditions for the use of said <br />premises for the purpose of protecting the value and <br />desirability of said property. <br />NOW, THEREFORE, Declarant hereby declares that all of the <br />Properties described above shall be held, sold, and conveyed <br />subject to the following: <br />a, Covenants <br />b. Easements <br />C. Restrictions <br />d. Conditions which are for the purpose of protecting <br />the value and desirability of the properties. <br />These provisions shall run with the real property above <br />described, They shall be binding on all parties having any <br />right, title or interest in the described Properties or any <br />part thereof, their heirs, successors, and assigns. They <br />shall inure to the benefit of each owner thereof until <br />October 1, 2014. <br />At that time said covenants would automatically extend for <br />successive periods of ten (10) years unless amended by <br />written agreement as follows: <br />a. Seventy percent (70 %) of the then owners of the <br />lots during the first fifteen (15) year period of <br />this instrument, and thereafter by not less than <br />fifty percent (50 %) of the owners of the lots. <br />Said covenants etc. may be changed in whole or in part, Said <br />amended agreement shall be executed and recorded in the <br />manner provided by law for conveyance of real estate. <br />H <br />
