200905095 ~a~~ _~_ of -~- Fourth AMENDMENT to RESTRICTIVE COVENANTS AND CONDiTlONS of FRANCIS VILLA COURTYARD HOMEOWNERS ASSOCIATION THE ITNDERSIGNED. who constitute seventy-five percent (7S'%) or mare of the of the voting members of Francis Villa Courtyard Homeowners Association, pursuant to the Restrictive Covenants and Conditions, filed May 1, 1998 as Document Na. 98-1D4090, and where Article I, paragraph 4 defines "Association" to mean Frances Villa Courtyard Homeowners Association inc. WHEREAS: The Buard of Directurs agree to revise Article II, Paragraph 7 of the Restrictive Covenants and Conditions for Francis Villa Courtyard Homeowner's Association to allow an alternate to atian of a satellite dish TV antennas (far thane that want it). NOW THEREFORE, IT IS RESOLVED TO DELETE THE EXISTING ARTICLE II, PARAGRAFII 7 OF DOCUMENT No. 98-104D90 AND REFLACE IT WITII A NEW PARAGRAPH 7. Article II, Paragraph 7 of Document No. 98-104090 shall be deleted in its entirety and a new paragraph 7. Substituted in its place to read as follows : 7. Utilities Ex aced Aerials and Lines. Certain easements ire established for installation and maintenance of utilities. All claims for damages, if any, arising out of the construction, maintenance and repair of utilities or on account of temporary ar other inconvenience caused thereby against Francis Villa Courtyard Homeowner's Association, or any of it's agents or servants, are hereby waived by all of the owners. a. Service lines for all public utility services which are available to a lot from an under- ground source shall be kept underground. b. No clotheslines shall be visible on the outside of any building. c. Exposed television antennas, radio aerials and related apparatus shall not be used on any lot except far the alternate satellite dish location Hated in paragraph 7. e. (2) below. d. Size of the satellite dish TV antennas shall be limited as follows: (1). The alder style dish that is four (4) feet or greater in diameter will Hat be allowed unless it can be installed in the patio in such a manner that it is below the fence tap and completely hidden from view from all owners as well all street and side- walktraffic. (2). For the alternate location noted in paragraph 7, e. (Z), the smallest size dish(y) available shall be used, depending on the system used and whether the system is far regular TV or high definition TV. e. li,ncation of :satellite dish TV antennas shall be limited as follows: (1).
