County, Nebraska, to install and dedicate to The <br />Association a pump and three (3) inch water well in the common <br />area in front of Suite 2807 and to connect that well through <br />underground pipes to the public storm sewer, and for other <br />valuable consideration the receipt whereof is hereby <br />acknowledged, Chad Vieth does hereby acknowledge, agree and <br />covenant as the Owner of Suite 2807 and his heirs, personal <br />representatives, successors and grantees (the Owner) as follows: <br />~.. The Owner is and shall be solely responsible for the <br />expense of the operation, maintenance, repair and replacement of <br />the pump and well and the pipes leading from it to the storm <br />sewer and for repairing and restoring the lawns, sidewalk and <br />driveways which lie above the pipes after any damage or <br />deterioration to them caused by the installation, operation, <br />maintenance, repair and replacement of the well and the pipes. <br />2. The operation of the well and the expense of the <br />operation of the well shall be the responsibility of the Owner. <br />3. Owner shall operate the well in such a manner within <br />its capacity to attempt to maintain the underground water level <br />under Suites 2803, 2805, 2807 and 2$09 at a reasonable level <br />below the basement floor levels of those Suites. <br />4. If Owner defaults in the performance of any of Owner's <br />obligations under the provisions of this Maintenance Covenant <br />then The Association shall have the right to cure the default <br />and assess the cost thereof against Suite 2807. <br />1 <br />
