<br />KNOW ALL MEN SY THESE PRESENTS that DONALD J. PAVELKA, JR., is the Successor
<br />Trustee under a Deed of Trust made and entered into on or about June S; 2006, by and between FRANCISCO
<br />MEDINA and NOEMI MEDINA, Trustors, and TICOR TITLE INSURANCE COMPANY, Trustee,
<br />MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., Beneficiary. Said Deed of Trust was
<br />recorded on June 9, 2006 as Instrument No. 2006-05212 of the Mortgage Records of Hall County, Nebraska.
<br />Said Deed of Trust having been assigned by virtue of an Assignment dated May 28, 2008 to THE SANK OF
<br />NEW YORK as Trustee for Popular Financial Services Mortgage/Pass Through Certificate Series
<br />#2006-D and which was filed for record on June 16, 2008 as Instrument No. 2008-OS 171. of the Mortgage
<br />Records of Hall County, Nebraska. Said Deed of Trust having been assigned by virtue ofan Assignment dated
<br />January 21, 2009 to TIIE BANK OF NEW YORK MELLON ,f/k/a THE BANK OF NEW YORK as
<br />successor by merger to JPMORGAN CHASE SANK, N.A., as Trustee for the benefit of the
<br />Certificateholders of Popular ABS, Inc. Mortgage-Pass Through Certificates Series 200(-D and which
<br />was filed for record on February 19, 2009 as Instrument No. 2009-01215 of the Mortgage Records of Hall
<br />County,. Nebraska. DONAIaD J. PAVELKA, JR. was appointed Successor Trustee by virtue of a
<br />Substitution of Trustee dated June 2S, 2008, and recorded August 6, 2008, as Instrument No. 2008-06781 in
<br />the Office of the Register of Deeds for Hall County, Nebraska. DONALD J. PAVELKA, JR, Grantor, in
<br />consideration of the sum of Forty-Five Thousand One and 00/100ths Dollars ($45,001.00) and other good and
<br />valuable consideration received from NICE HOMES, INC. does hereby grant, bargain, sell, convey and
<br />confirm unto NICE HOMES, INC., (hereinafter "Grantee" where appropriate), the following-described real
<br />property ui Hall County, Nebraska, to wit:
<br />THE NORTHERLY TWELVE (12) FEET OF LOT FOUR (4) AND ALL OF LOT TWO
<br />(2), IN BLOCK :TWENTY FOUR (24), IN UNIVERSITY FLACE, AN ADDITION TO
<br />THE CITY OF GLAND ISLAND, HALL COUNTY, NEBRASKA.
<br />to have and to hold the above-described premises together with all tenements, hereditaments and appurtenances
<br />thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. Grantor does hereby
<br />cove-tant with Grantee and Grantee's successors and assigns:
<br />That FRANCISCO MEDINA and NOEMt MEDINA, as Trustors, failed. to pay to Beneficiary
<br />payments which were contractually due, and the Grantor, at the request of the Beneficiary, elected to
<br />declare the entire unpaid. principal balance, together with uiterest thereon at once immediately due and
<br />payable.
<br />2. That a Notice of Default as required by § 76-1006 was filed by Grantor on February 26, 2009, as
<br />Instrument No.2009-01432 in the Office of the Register of Deeds ofHall County, Nebraska. A copy
<br />of said Notice of Default was thereafter mailed to all parties entitled to notice, pursuant to said Deed of
<br />Trust and in compliance with § 76-1008, R.R.S. Nebraska.
<br />That the Trustor failed to cure the default referenced in the Notice of Default within 30 days after
<br />filing of the Notice of Default.
<br />4. That a Notice of Trustee's Sale was filed .by Grantor on. April l , 20Q9, ~s Instrument No.2009-02360
<br />in the Office of the Register of Deeds of Hall County, Nebraska. A copy of said Notice of the time
<br />and place of the sale was thereafter mailed to all parties entitled to notice pursuant to said Deed of
<br />Trust and in compliance with § 76-1008, R.R.S. Nebraska..
<br />That Grantor as required by § 76-1007 published a Notice of Trustee's Sale to be held on May 21,
<br />2009, at 9:00 a.m. at the Hall County Courthouse, 111 West First Street, Grand Island, Nebraska Said
<br />Notice was published in the Grand Island Dependant, a legal newspaper of Grand Island, Hall County,
<br />Nebraska, once a week for five consecutive weeks commencing on Apri110, 2009, and ending May 8,
<br />2009. The last publication notice was at least ten days prior to the Trustee's Sale held on May 21,
<br />2009, and said sale was not later than 30 days after the last publication of notice.
