<br />THAT WHEREAS, Under the Nebraska'IYust Deeds Act, Neb. Rev. Stat. ~~ 76-1001 ~'
<br />to 76-1018 (Reissue 2003), a Trust Deed was executed by Crane Center, L.L.C., a
<br />Nebraska limited liability company, Michael D. T~aasch, member, and Diane K. Raasch,
<br />member, to Lincoln Federal Savings Bank of Nebraska, Trustee, for the benefit of Lincoln
<br />Federal Savings Bank of Nebraska ,the beneficiary named therein, on September 2, 2005
<br />and filed for record on September 22, 2005 at Instrument No. 0200509429 in the Records
<br />of the Register of Deeds in and for Hall County, Nebraska.
<br />WHEREAS, Trustee filed for record in the office of the Register of Deeds of the
<br />county wherein the property was situated, a Notice of Default, identifying the Trust Deed
<br />by stating the name of the Trustor Warned therein and giving the book and page numbers
<br />where the same was recorded, a description of the Trust property, and said Notice
<br />containing a statement that a breach of an obligation for which the Trust property was
<br />conveyed as security had occurred, and setting forth the nature of such breach and of
<br />the Trustee's election to sell or cause to be sold such property to satisfy the obligation;
<br />and
<br />WHEREAS, after the lapse of not less than one month, the breach or default was
<br />not cured as required by law; and
<br />WHEREAS, the Trustee gave written notice of the time and place of sale
<br />particularly describing the property to be sold by publication of said notice, at least five
<br />(5) times, once a week for five (5) consecutive weeks, the last publication being at least
<br />ten (10) days but not more than thirty (30) days prior to the sale, in a newspaper having
<br />general circulation in the county in which the property was to be sold or some part
<br />thereof was situated, all according to the Nebraska Trust Deeds Act; and
<br />WHEREAS, the sale was held at the time and place designated in the Notice of Sale
<br />which was between the hours of 9:00 a.m. and 5:00 p.m., and was at the courthouse of
<br />the county in which the property to be sold or some part thereof was situated; and
<br />WHEREAS, the Notice of Sale was in substantially the form as provided by the
<br />Nebraska Trust Deeds Act; and
<br />WHEREAS, on the date and at the time and place designated in the Notice of Sale,
<br />the Trustee sold the property at public auction to Lincoln Federal Savings Bank of
<br />Nebraska which was the highest bidder, for the sum of One Million and No/ 100 Dollars
<br />($1, 000, 000.00); and
<br />WHEREAS, the sale was conducted according to the Nebraska Trust Deeds Act;
<br />and
<br />WHEREAS, the Notice of Default and the Notice of Sale were duly mailed by
<br />registered or certified mail with postage prepaid, to all persons who had requested notice
<br />according to law, or according to the Deed of'IYust, referenced herein; and
<br />WHEREAS, the Trustee has complied with all of the provisions of the Nebraska
<br />Trust Deeds Act.
<br />NOW, THEREFORE, I, as Trustee under the Deed of Trust herein referenced, as
<br />aforesaid, in consideration of the premises and by virtue of the powers vested in me by
