REQUEST FOR NOTICE. Trustors and Beneficiary hereby request a copy of any <br />notice of default, and a copy of any notice of sale thereunder, be mailed to each person who is a <br />party hereto at the address for such person set forth in the first paragraph of this Trust Deed. <br />lb. GOVERNING LAW. This Trust Deed shall be governed by the laws of the State of <br />Nebraska. <br />17. SUCCESSORS AND ASSIGNS. This Trust Deed, and all terms, conditions and <br />obligations herein, apply to and inure to the benefit of and binds all parties hereto, their heirs, <br />legatees, devisees, personal representatives, successors, and assigns. However, all devisees, <br />personal representatives, successors, and assigns shall also be bound by the terms hereof, and of <br />any notes to which this Deed of Trust is incorporated by reference, including, but not limited to, <br />those provisions related to payment of principal and interest and release of liens upon the sale of <br />subdivided portions of the property. The term "Beneficiary" shall mean the owner and holder of <br />any note executed in reference to this Deed of Trust, and any Surety who issues bonds under <br />Indemnity Agreements as provided herein, whether or not named as Beneficiary herein. <br />18. JOINT AND SEVERAL LIABILITY: All covenants and agreements of Trustors <br />shall be joint and several. <br />19. SEVERABILITY. In the event of one or more of the provisions contained in this <br />Trust Deed, or any provision in any note secured hereby, or any other security instrument given <br />in connection with this transaction shall for any reason be invalid, illegal or unenforceable in any <br />respect, such invalidity, illegality, or unenforceability shall, at the option of Beneficiary, not <br />affect any other provision of this Trust Deed, but this Trust Deed shall be construed as if such <br />invalid, illegal, or unenforceable provision had never been contained herein or therein. if the lien <br />of the Trust Deed is invalid or unenforceable as to any part of the debt, or if the lien is invalid or <br />unenforceable as to any part of the Property, the unsecured or partially secured portion of the <br />debt shall be completely paid prior to the payment of the remaining and secured or partially <br />secured portion of the debt, and all payments made on the debt, whether voluntary or involuntary <br />shall be considered to have been first paid on and applied to the full payment of that portion of <br />the debt which is not secured or not fully secured by the lien of this Trust Deed. <br />20. TRUSTEE LIABILITY. So long as the Trustee shall act in good faith and in <br />reliance upon notices and other information which it, in its sole discretion may deem to be <br />reliable, andsa long as Trustee shall exercise reasonable prudence .and care in its administration <br />hereunder, Trustee shall not be liable for any loss or damage sustained or incurred by the <br />Trustors or any Beneficiary or by any other persons whomsoever, it being expressly stipulated <br />that the Trustee shall be liable only for its own gross negligence and willful default in the <br />premises. <br />21. WAIVER OF HOMESTEAD EXEMPTION. Trustors hereby release and waive <br />all rights under and by virtue of the Homestead Exemption Laws of the State in which the Real <br />Property is located and Trustors expressly waive any rights of Trustors under those laws and <br />covenant not to invoke them as a means to defeat or diminish any rights of Surety hereunder. <br />Trustors further release, waive, and forever relinquish, in regard to Surety, any succession <br />interest ar other interest arising in the Real Property by reason of marriage under the laws of the <br />State in which the Real Fraperty and Trustors expressly covenant not to invoke such rights as a <br />defense to or to avoid any of Surety's rights hereunder. <br />6 <br />
