Agurta concerning the two construction liens <br />filed on her property located in Cairo, Nebraska. I am referring to construction liens filed on <br />September 26, 2008, two different instrument numbers, one being 0200808210 and secondly, <br />instrument number 0200808209 here in Hall County, Nebraska. <br />I can only advise you at this time that all of the material used on the properties to this <br />point has been paid for by Mrs. Agurto and her husband. <br />At the time of commencement of any contract, Mrs. Agurto did not contract with a legal <br />entity of Bellamy Homes as shown on both construction liens. <br />As you know, your services were terminated in August of 2008 for inability to complete <br />the work in a timely manner as called far under the terms of your contract. <br />At this point in conjunction with Section 52-140 ofthe Nebraska Revised Statutes and the <br />Nebraska Construction Lien Act, this letter constitutes notice to you that Mrs. Agurto is <br />demanding that you commence and institute judicial proceedings within 30 days from the receipt <br />of this letter. <br />Sincerely, <br />Q• <br />Ralph A.
