200904065 <br />"Bonds" or "Building Bonds" or "2009 Bonds" shall mean the Refunding Bonds <br />(Grand Island Administrative Addition Project), Series 2009, issued by Lessor pursuant to <br />the Indenture to provide funds to refinance the construction and acquisition by Lessor of the <br />"Project ". <br />"Indenture" shall mean that Trust Indenture and Security Agreement, dated as of <br />March 1, 2003, by and between Lessor and Wells Fargo Bank, National Association, <br />formerly known as Wells Fargo Bank Nebraska, National Association, as Trustee, as <br />supplemented by that Supplemental Trust Indenture and Security Agreement, dated as of <br />May 1, 2009, by and between Lessor and Wells Fargo Bank, National Association, as <br />Trustee, governing the Building Bonds. <br />"Site" shall mean the real estate described on Exhibit A as the site for the Project. <br />"Trustee" shall mean Wells Fargo Bank, National Association, as Trustee under the <br />Indenture and any successor or successors as such Trustee under the Indenture. <br />"Underwriter" shall mean Ameritas Investment Corp. as purchaser of the Building <br />Bonds under the terms of the Indenture. <br />WHEREFORE, IN CONSIDERATION of the mutual covenants, promises and agreements <br />contained in this Amendment, the parties agree that the Original Agreement is hereby amended and modified <br />as follows:: <br />ARTICLE I <br />Section 1.1.
