<br />THIS AMENDMENT to Grant of Easement ( "Amendment "), made this /6 day of
<br />May, 2009, by and between Casey's Retail Company, an Iowa corporation, whose business
<br />address is 1 SE Convenience Blvd., Ankeny, Iowa 50021 (TIN: 20- 1025921)( "Casey's ") and
<br />TLC Properties, Inc., a Louisiana corporation, whose business address is 5551 Corporate
<br />Boulevard, Baton Rouge, Louisiana, 70808 (TIN: 72- 0640751)( "TLC "), WITNESSETH:
<br />WHEREAS, Casey's is the owner of a tract of land ( "Casey's Tract ") situated in the City
<br />of Grand Island, Hall County, Nebraska, described as follows:
<br />All of Park Reserve of the Resubdivision of Block One (1), GILBERT'S SECOND
<br />ADDITION to the City of Grand Island, Hall County, Nebraska, except for a triangular
<br />piece of ground beginning at the intersection of the East line of Broadwell Avenue and
<br />the West line of Eddy Street, going South along the East line of Broadwell Avenue, a
<br />distance of 50 feet; thence Easterly to the West line of Eddy Street; thence Northerly a
<br />distance of 50 feet along the West line of Eddy Street to the place of beginning.
<br />Pursuant to a Corporate Warranty Deed from Gas `N Shop, Inc., as grantor, executed December
<br />18, 2007 and recorded January 14, 2008 as Instrument No. 200800297, in the office of the Hall
<br />County Register of Deeds; and
<br />WHEREAS, by Grant of Easement executed April 30, 2004 and recorded July 14, 2004
<br />as Instrument No. 200406903 in the office of the Hall County Register of Deeds ( "Grant of
<br />Easement "), Casey's predecessor in interest, Gas `N Shop, Inc., conveyed to TLC a perpetual
<br />easement ( "Easement ") including the right to construct, service, maintain, improve or replace an
<br />outdoor advertising structure upon a portion of the Casey's Tract consisting of the following
<br />described land ( "Current Easement Area").
<br />A part of the Park Reserve of Gilbert's Subdivision of Block One (1), GILBERT'S
<br />SECOND ADDITION to the City of Grand Island, Hall County, Nebraska, being more
<br />particularly described as follows:
<br />Beginning at the Southeast corner of said Park Reserve; thence running South 61 048'46"
<br />West on the Southerly line of said Park Reserve for Sixty -five (65.00) feet; thence North
<br />28 °31'00" West parallel with the Easterly line of said Park Reserve for Twenty (20.00)
