<br />~.. <br /> <br />200903244 <br /> <br />Trustor further covenants and agrees with Beneficiary as follows: <br /> <br />(1) To pay all liens, judgments or other assessments against said Trust Estate and to pay when due <br />all taxes, rents, fees or charges upon said Trust Estate or under any lease, permit, license or privilege assigned <br />to Beneficiary as additional security to this Trust Deed, including those on public domain, unless waived from <br />time to time by Beneficiary. At the option of Beneficiary, Trustor shall pay all insurance premiums and real <br />estate taxes by making monthly payments to Beneficiary equal to 1/12 of the estimated annual insurance <br />premiums and taxes each year, to be held in escrow by Beneficiary and applied to such real estate taxes and <br />insurance premiums as the same become due or delinquent. <br /> <br />(2) To insure and keep insured buildings and other improvements now on or hereafter placed on said <br />Trust Estate to the extent of the full value of the collateral. Such insurance shall be approved by and deposited <br />with Beneficiary within ten (10) days ofthe date of this instrument, and endorsed with loss thereunder payable <br />to Beneficiary and naming Beneficiary as additional insured. Any sums so received by Beneficiary may be <br />used to pay for reconstruction of the destroyed improvements or if not so applied may, at the option of the <br />Beneficiary, be applied in payment of any indebtedness matured or unmatured secured by this Trust Deed, <br />unless waived from time to time by Beneficiary. At Beneficiary's option, Trustor shall pay all insurance <br />premi ums by making monthly payments to Beneficiary equal to 1/ 12th of the estimated annual premiums to <br />be held in escrow by the Beneficiary and applied to such premiums as the same become due or delinquent. <br /> <br />(3) To keep all buildings, fixtures, and other improvements now on or hereafter placed on said Trust <br />Estate occupied and in good repair, maintenance and condition, and to neither commit nor permit any acts of <br />waste, violation or noncompliance with zoning regulations or city code provisions, or any impairment of the <br />value ofthe Trust Estate. Beneficiary may enter upon the Trust Estate to inspect the same or to perform any <br />acts authorized herein or in the loan agreement. <br /> <br />(4) In the event Trustor fails to pay any liens, judgments, assessments, taxes, rents, fees or charges <br />or maintain any insurance on the property, buildings, fixtures or improvements as provided herein or in the <br />loan agreement, Beneficiary may, at its option, make such payments or provide insurance, maintenance or <br />repairs and any amounts paid therefore shall become part of the principal indebtedness secured hereby, be <br />immediately due and payable and bear interest from the date of payment at the rate of sixteen percent (16%) <br />per annum. The advancement by Beneficiary of any such amounts shall in no manner limit the right of <br />Beneficiary to declare Trustor in default or exercise any of the Beneficiary's other rights and remedies. <br /> <br />(5) In the event Beneficiary is a party to any litigation affecting the security or the lien of this Trust <br />Deed, including any action by Beneficiary to enforce this Trust Deed or any suit in which Beneficiary is <br />named a defendant (including condemnation and bankruptcy proceedings), Beneficiary may incur expenses <br />and advance payments for abstract fees, attorney fees, costs, expenses, appraisal fees and other charges and <br />any amounts so advanced shall become part of the principal indebtedness secured hereby, be immediately due <br />and payable and bear interest as provided in Paragraph (5) above. <br /> <br />(6) Any awards made to Trustor or his successors by the exercise of eminent domain are hereby <br />assigned to Beneficiary; and Beneficiary is hereby authorized to collect and apply the same in payment of any <br />indebtedness, matured or unmatured, secured by this Trust Deed. <br /> <br />-3- <br />
