On August 26, 2003, the undersigned executed a Personal <br /> <br /> <br />Representative's Deed (Executrix Deed) conveying title to the Property and such <br /> <br /> <br />deed was recorded on June 18, 2004, as Instrument No. 0200406069 in the Hall <br /> <br /> <br />County Register of Deeds (the "Executrix Deed"). <br />7. The Executrix Deed conveyed an undivided 22.4 7% interest to the Ted <br /> <br /> <br />H. Liggett Non-Qualifying Trust, Lee G. Liggett and Lizabeth L. Liggett, Trustees <br /> <br /> <br />and an undivided 10.86% interest to the Ted H. Liggett Marital Trust, Lee G. <br /> <br /> <br />Liggett and Lizabeth L. Liggett, Trustees. <br /> <br /> <br />8. It was the intent of the Executrix Deed to convey the entirety of the <br /> <br /> <br />undivided one-third interest of Ted H. Liggett in the Property to the Grantees <br /> <br />referenced above and such conveyance was intended to accomplish the estate plan <br /> <br /> <br />of Ted H. Liggett, i.e., to transfer two-thirds of Ted H. Liggett's undivided one-third <br /> <br /> <br />interest in the Property to the Ted H. Liggett Non-Qualifying Trust and one-third <br /> <br /> <br />of Ted H. Liggett's undivided one-third interest in the Property to the Ted H. <br /> <br /> <br />Liggett Marital Trust. <br />9. The undersigned, Executrix (Personal Representative) of the Estate of <br /> <br />Ted H. Liggett, desires to clear up any potential discrepancies in the chain of title <br /> <br />to the Property based upon the percentage interests allocated in the Deed. <br /> <br />2 <br />
