<br />200902576 <br /> <br />The Obligations shall include, without limitation, any interest, costs, fees and expenses which <br />accrue on or with respect to any of the foregoing, whether before or after the commencement of any case, <br />proceeding or other action relating to the bankruptcy, insolvency or reorganization of Trustor." <br /> <br />3. Modification of Section 2.15(b)(v) of Deed of Trust. From and after the Effective <br />Date, Section 2.15(b)(v) of the Deed of Trust is hereby amended and restated in its entirety as <br />follows: <br /> <br />"to the extent the current term of the Site Lease does not extend beyond the maturity date of the <br />Loan, shall exercise (not later than thirty days prior to the last date on which Trustor may timely do so) <br />each right or option of Trustor under the Site Lease to extend the term thereof, provided that Trustor shall <br />not be required to exercise any such right or option if it obtains the prior written consent of the Beneficiary <br />to the same, such consent to not be unreasonably withheld." <br /> <br />4. Ratification of Deed of Trust. Trustor hereby ratifies and confirms the Deed of <br />Trust as modified hereby, and the liens and security interests granted therein, and the priorities of <br />such liens and security interests. Trustor agrees that this Modification shall in no manner affect <br />or impair the liens and security interests created pursuant to the Deed of Trust, and that such <br />liens and security interests shall not in any manner be waived, released, extinguished, or <br />otherwise adversely affected in any way, the purposes of this Modification being to modify the <br />Deed of Trust as set forth herein, and to carry forward all liens and security interests securing <br />same. <br /> <br />5. Governing Law. This Modification shall be governed by and construed In <br />accordance with the law ofthe State in which the Property is located. <br /> <br />6. Execution in Counterparts.
