<br />TRUSTEE'S DEED
<br />
<br />This instrument, made this 16th day of March, 2009, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to
<br />a power of sale contained in that certain Deed of Trust recorded on July 25, 2006 as Instrument No.
<br />0200606611 in the office of the Register of Deeds of Hall County, Nebraska, and the Secretary of
<br />the Department of Housing and Urban Development, hereinafter called "Grantee".
<br />
<br />WHEREAS, on December 17, 2008, Grantor, executed a Notice of Default pursuant to
<br />which notice was given to Craig Dubbs and Gina M. Dubbs, husband and wife, Trustors, under that
<br />certain Deed of Trust recorded on July 25, 2006 as Instrument No. 0200606611 in the office of the
<br />Register of Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />
<br />Lot Three (3), Meadow Lane Fourth Subdivision, Hall County, Nebraska,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on December 22, 2008, as Instrument No. 0200810319.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. S76-1008.
<br />
<br />Subsequent thereto, beginning on January 26,2009, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 p.m. on March 10, 2009. Publication of such notice was
<br />made for five consecutive weeks on January 26, 2009, February 2, 2009, February 9, 2009,
<br />February 16, 2009 and February 23, 2009, the last publication being at least ten (10) days but not
<br />more than thirty (30) days prior to the date of sale.
<br />
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. S76-1008.
<br />
<br />Pursuant to said Notice of Trustee's Sale, John Cunningham, attorney for Grantor, did at the
<br />time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public
<br />auction, and did sell the same to SunTrust Mortgage, Inc. for the sum of $131,739.79, it being the
<br />highest bidder therefor. SunTrust Mortgage, Inc. has assigned all of its right, title and interest in
<br />such bid to Grantee.
<br />
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $131,739.79 so
<br />bid and paid as aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its successors
<br />and assigns forever, all the estate, right, title and interest of which the said Craig Dubbs and Gina M.
<br />Dubbs, husband and wife, and their successors in interest, were seized or possessed at the time said
<br />Deed of Trust was given, or at any time thereafter, in and to the premises sold as aforesaid, to-wit:
