<br />NOTICE IS HEREBY GIVEN that on the I 9~y of March, 2009, Wells Fargo Bank Minnesota, National
<br />Association, solely in its capacity as Trustee, under the Series Supplement to the Master Facility Agreement dated August
<br />30, 2001, Series 2001-PBI Trust, as the plaintiff, filed its Complaint in the District Court of Hall County, Nebraska,
<br />against Ted H. Menard and Sharon L. Menard, as defendants, the object and prayer of such Complaint being to obtain an
<br />accounting, to foreclose a deed of trust executed by said Ted H. Menard and Sharon L. Menard, husband and wife, to
<br />American Pioneer Title Insurance Company, Trustee, for the benefit of Homeowners Loan Corp., Beneficiary, to foreclose
<br />any interest in or lien upon the real estate hereinafter described of the above-named defendants, to obtain an order for the
<br />sale of the real estate hereinafter described for the satisfaction of the indebtedness secured by such deed of trust and to
<br />obtain other equitable relief; that such deed oftrust is dated July 20, 2001, and was recorded August 1,2001, as Instrument
<br />Number 200107601 in the Oflice of the Register of Deeds of Hall County, Nebraska, and conveyed to such beneficiary the
<br />following described real estate situated in Hall County, Nebraska, to-wit:

<br />sold, transferred, and assigned to Wells Fargo Bank Minnesota N.A., by written assignment recorded on February 9, 2004,
<br />as Instrument Number 200401122 in the Ofliee of the Register of Deeds of Hall County; that such deed of trust was sold,
<br />transferred, and assigned to The Provident Bank, by written assignment recorded on June 4, 2004, as Instrument Number
<br />200405560 in the Office of the Register of Deeds of Hall County, Nebraska; and that such deed of trust was sold,
<br />transferred, and assigned to the plaintiff, by written assignment recorded on January 24, 2006, as Instrument Number
<br />200600636 in the Office of the Register of Deeds of Hall County, Nebraska.
