<br />NOTICE IS HEREBY GIVEN that on the ~ day of March, 2009, The Bank of New York
<br />Mellon f/k/a The Bank of New York as successor to JPMorgan Chase Bank, N.A., as trustee for the benefit of
<br />the Certificateholders of Popular ABS, Inc. Mortgage Pass-Through Certificates Series 2006~C, as the
<br />plaintiff, filed its Complaint in the District Court of Hall County, Nebraska, against Mario A. Perales
<br />and Chastity A. Perales, as the defendants, the object and prayer of such Complaint being to obtain an
<br />accounting, to foreclose a deed of trust executed by Mario A. Perales and Chastity A. Perales, husband
<br />and wife, to Ticor Title Agency Company, Trustee, for the benefit of Mortgage Electronic Registration
<br />Systems, Inc., acting solely as Nominee for Popular Financial Services, LLC, Beneficiary, to foreclose any
<br />interest in or lien upon the real estate hereinafter described of the above-named defendants, to obtain an
<br />order for the sale of the real estate hereinafter described for the satisfaction of the indebtedness secured by
<br />such deed of trust and to obtain other equitable relief; that such deed of trust is dated May 23, 2006 and
<br />was recorded on May 30, 2006 as Instrument No. 200604811 in the Office of the Register of Deeds of
<br />Hall County, Nebraska, and conveyed to such beneficiary the following described real estate situated in
<br />Hall County, Nebraska, to-wit:

<br />The Easterly Twelve (12) feet of Lot Three (3) and the Westerly Fifty-eight (58) feet of
