Hastings owns real property located in Grand Island, Nebraska legally described <br />on Exhibit "A" attached and incorporated by this reference ("Hastings Property"). <br /> <br />B. Woodland is purchasing or has purchased a portion of the Hastings Property, <br />legally described on Exhibit "B" attached and incorporated by this reference <br />("Woodland Property"). <br /> <br />C. Woodland plans to develop and construct a townhome residential development on <br />the Woodland Property which will be accessed through Pennsylvania Avenue and <br />New York Avenue. <br /> <br />- D. Woodland has received approval from the City of Grand Island to construct and <br />develop a townhome residential development on the Woodland Property, <br />conditioned upon the Woodland Property being benefitted by a Turn Around Area <br />located at the east end of Pennsylvania Avenue. <br /> <br />E. Hastings currently owns the unimproved property adjacent to and east of the <br />Woodland Property and has agreed to provide a temporary easement to, on and <br />over the Hastings Property to allow for a temporary Turn Around Area directly east <br />of Pennsylvania Avenue. <br /> <br />F. Woodland desires to acquire and Hastings desires to convey an easement over and <br />through the Easement Area, defined below, located on the Hastings Property in <br />accordance with the terms and conditions of this Easement. <br /> <br />NOW THEREFORE, in consideration of the benefits to be derived from the facilities <br />and the utility lines described herein, and in further of One and No/ 100 Dollars ($1.00), <br />the receipt of which is hereby acknowledged, and other valuable consideration, Hastings <br />and Woodland agree as follows: <br /> <br />1. Access Easement. Hastings does hereby convey to Woodland, its respective <br />successors and assigns, a limited and nonexclusive easement with the right to use for <br />ingress and egress purposes the turn around area east of Pennsylvania Avenue where <br /> <br />0919896.3 <br />
