<br />'. <br />~. <br /> <br />. <br />. <br /> <br />200901857 <br /> <br />WHEREAS, pursuant to the tenus of the Agreement, Grantors agreed to grant to Gran- <br />tees ingress and egress access to Tract 1 to and from U.S. Highway No. 281 over through and <br />upon the existing private drive located on Tract 2 upon the tenus and conditions contained in the <br />Agreement and as said forth hereinbelow; and <br /> <br />WHEREAS, Grantor and Grantees have caused a survey to be completed to legally <br />describe the Easement Area within which said existing private drive is located, a copy of which <br />survey is attached hereto as Exhibit "A", and is incorporated herein and made a part hereofby <br />this reference (the "Easement Area"). <br /> <br />NOW, THEREFORE, for good and valuable consideration, the receipt and adequacy of <br />which is hereby acknowledged Grantors do hereby grant unto Grantees and to Grantee's heirs, <br />successors, invitees and assigns a perpetual non-exclusive easement over, through and upon the <br />Easement Area for ingress and egress access to Tract I to and from U.S. Highway No. 281 <br />located directly adjacent to the east of Tract 2. This easement shall be a perpetual non-exclusive <br />easement, shall run with the land and shall inure to and be binding upon the parties hereto, their <br />heirs, successors and assigns and all parties claiming ownership of Tract 1 or Tract 2 through the <br />parties hereto. <br /> <br />The within the easement is being granted to Grantees on the condition that Grantees shall <br />assume responsibility to keep the private driveway located within the Easement Area in good <br />condition and repair at Grantees' sole cost and expense. <br /> <br />Dated this I D day of March, 2009. <br /> <br />~7 :l~ <br />C;, i <br />La~ <br />~:J'ic~~ 711. ~~4t-J <br />Sharleen M.
