<br />KEVIN V. WOODWARD, being first duly sworn, deposes and says:

<br />1. He is the President of KEVIN WOODWARD CONSTRUCTION AND CUSTOM
<br />RENOV A nONS, INC., a Nebraska corporation, hereinafter referred to as "Woodward
<br />Construction", which made, executed and delivered that certain Special Warranty Deed to
<br />HOME FEDERAL SAVINGS AND LOAN ASSOCIA nON OF GRAND, a federally chartered
<br />savings and loan association, conveying the following-described property, to-wit:

<br />Lot Sixty (60), Amick Acres West Subdivision, Hall County, Nebraska;
<br />
<br />Lot Twenty~Seven (27), Block One (1), in Brentwood Subdivision, in the City of
<br />Grand Island, Hall County, Nebraska;
<br />
<br />Lot Two (2), Block One (1), Woodland Park Second Subdivision, in the City of
<br />Grand Island, Hall County, Nebraska;
<br />
<br />Lot Seven (7), Block Two (2), Woodland Park Second Subdivision, in the City of
<br />Grand Island, Hall County, Nebraska; and
<br />
<br />Lot Four (4), Block Two (2), Woodland Park First Subdivision, in the City of
<br />Grand Island, Hall County, Nebraska.

<br />2. That the undersigned make this Affidavit for and on behalf of Woodward
<br />Construction pursuant to a resolution of its Directors.
<br />
<br />3. That the aforesaid Special Warranty Deed was intended to be and was an absolute
<br />conveyance of the title to said premises to the Grantee named therein, and was not, and is not
<br />now, intended as a mortgage, trust conveyance, or security of any kind; that it was the intention
<br />of Woodward Construction as Grantor in said deed to convey, and by said deed the Woodward
<br />Construction did convey to the Grantee therein all of its right, title and interest absolutely in and
<br />to said premises; and that possession of said premises has been surrendered to the Grantee.
<br />
<br />4. That in the execution and delivery of said Special Warranty Deed, Woodward
<br />Construction was not acting under any misapprehension as to the effect thereof, and acted freely
<br />and voluntarily and was not acting under coercion or duress.
