<br />NOTICE IS HEREBY GIVEN that on the '" day ofFc;b..."u.y, 2009, The Bank of New York
<br />Mellon f/k/a The Bank of New York as successor to JPMorgan Chase Bank, N.A., as trustee for the benefit of
<br />the Certificateholders of Papillar ABS, mc. Mortgage Pass-Through Certificates Series 2005-D, as the
<br />plaintiff, filed its Complaint in the District Court of Hall County, Nebraska, against James M. Berger,
<br />Michael F. Kivett, Trustee, and American General Financial Services, Inc., Beneficiary, as the
<br />defendants, the object and prayer of such Complaint being to obtain an accounting, to foreclose a deed of
<br />trust executed by James M. Berger, marital status unknown, to First American Title, Trustee for the benefit
<br />of Mortgage Electronic Registration Systems, mc., acting solely as Nominee for Equity One, mc.,
<br />Beneficiary, to foreclose any interest in or lien upon the real estate hereinafter described of the above-
<br />named defendants, to obtain an order for the sale of the real estate hereinafter described for the
<br />satisfaction of the indebtedness secured by such deed of trust and to obtain other equitable relief; that
<br />such deed of trust is dated October 20, 2005 and was recorded on November 3, 2005 as mstrument No.
<br />200510890 in the Office of the Register of Deeds of Hall County, Nebraska, and conveyed to such
<br />beneficiary the following described real estate situated in Hall County, Nebraska, to-wit:
