<br />82= ~tv50~ <br />EASEMEf3T <br />This agreement is entered into this /I~ day <br />of 1982 is entered into by Grand Island M-all, Ltd., <br />a Nebraska Limited Partnership, hereinafter called "the <br />Mall" and Northwest National Bank of Grand Island, herein- <br />aft:e:~ called "the Bank". <br />~WHEftEAS, the Mall is selling to the Bank Lot Two <br />(2) in Grand Island Mall Third Subdivision in the City of <br />Grand Island, Hall County, Nebraska and the Bark desires <br />to have proper access rights to and from all public <br />utilities needed by it for the operation of its facilities <br />on the land conveyed from 'the Mall. <br />WITNESSETH: <br />I. In consideration of the sale of the real <br />estate by the Ma11, to the Bark legally described as Lot <br />Two (2) Grand Island Mall Third Subdivision in the City <br />of Grand island, Hall County, iebraska, L'his ease:nen~ anti <br />agreement is made and entered into. <br />2. The Mall grants to the Bank the right to <br />connect to any existing electric power, telephone, gas, <br />and water lines lying north and east of the property above <br />described and grants to the Bank the right of egress and <br />ingress over property owned by the Mall, provided that. all <br />such utility lines shall be buried and constructed in <br />accordance with all appropriate -regulations, codes, statutes <br />and ordinances effecting such uta.lities, further the Mall <br />grants to the Bankti-ie right. {:.o use and rraintain such <br />facilities under property it owns. <br />3.
