I <br />82-- ~~91 <br />ASSIGiJMENT OF UNDIVIDED INTEREST IN <br />INSTALLMENT CONTRACT FOR SALE OF REAL ESTATE <br />This Assignment of, Undivided Interest in Installment Contract <br />for Sale of Real Estate is made on iJOVember ~, 1982, between <br />VIOLA E. EWOLDT, a widow, Assignor, and VIOLA E. EWOLDT and JOSEPI3 H. <br />EWOLIIT, mother and son, as jcint tenants and not as tenants in <br />common, Assignees. <br />In consideration of LOVE and AFFECTION, Assignor assigns to <br />Assignee s; as joint tenants and not as tenants in common, (1) all of <br />Assignor's undivided one-eighth (1/8th) right, title and interest in <br />and. to the Installment Contract for Sale of Real Estate made and <br />entered into on July 2, 1979, by and between Edwin Ewoldt, a single <br />man; Carl Ewoldt and Viola Ewoldt, husband and wife; Rudolph Ewoldt <br />and Bernadine Ewoldt, husband and wife; Daniel Ewoldt and Evelyn <br />Ewoldt, husband and wife; Lillian Partaka, a widow; Maxine Eggleston <br />and Melvin Eggleston, wife and husband; Lorraine Barnhart and :^7alter <br />Barnhart, wife and husband; and Eloise Ewoldt, a single-person, as <br />Sellers, and Theodore J. Robb, as Buyer, by the terms of which Sellers <br />sold to Buyer by installment sale contract the real estate described <br />in Exhibit A, attached and incorporated by reference, and (2) Assign- <br />or's undivided one-eighth (1, 8th) right, title and interest to the <br />property described in the installment sale contract. <br />Assignor assigns to Assignees, as joint tenants and not as tenants <br />in common, all of the partial payments payable to Assignor under the <br />terms of tine installment sale contract and auti~orizes and. directs The <br />First National ~3ank of Grand Island, designated Escrow Agent in the <br />installment sale contract, to pay and distribute to Assignees, as <br />joint tenants and not as tenants in conunon, the Assignor's share of <br />principal and interest payable by Buyer to the Escrow Agent under the <br />teams of tlae installment sale contract. <br />Assignees, as joint tenants and not as tenants in common, accept <br />assignrent from Rssignor of Assignor's undivided one-eighth (1/8th) <br />right, title and interest in the installment sale contract and the <br />property described in the installment sale contract, and all other <br />rights and benefits of Assignor under the terms and conditions of <br />the installrent sale contract. <br />Assignees intend to and are contracting as joint tan ants and <br />not as tenants in common in executing ti2is instrument and in acce_ot- <br />ing the assignment from Assignor. <br />Executed: November ca 1982. <br />, -, . ~ <br />(viola E. :woldt) <br />ASSIi~iJOR <br /> <br /> <br /> <br />
