<br />Walter H. Gunther aka Walter H. Guenther and Laurine Gunther aka
<br />Guenther, Husband and Wife ,herein called the mortgagor whether one or [Wore,
<br />in consideration of Sixteen thousand five hundred and no/100 Dollars ($16,500.00)
<br />receiveei from mortgagee, does mortgage to the -City of Grand Island, Nebraska,
<br />a Municipal Corporation, the col lowing described real estate, to-wit:
<br />Lot Seventeen (17), in Block Three (3), in College Addition
<br />to West Lawn, in Grand Island, Nebraska
<br />dud the mortgagor does hereby covenant with the mortgagee and with .mortgagee's heirs aad
<br />assigns that mortgagor is lawfully seised of said premises, that they arc Free -from encumbrance, that
<br />mortgagor has good right and lawful authority to convey the same, and that mortgagor warrants and
<br />will defend the title to said premises against the lawful claims of all persona whomsoever.
<br />This mortgage is given to secure the- payment of the prmnissory note of this date made by
<br />utortgagor for ~ 16,500.00 payable, in accordance with said note.
<br />hlortgugor shall pay all taxes and assessments lcried upon said real property and all other Lazes
<br />levied ou this tuortgage or the note which this mortgage is given to secure before the same become delin-
<br />4uent and skull iuaiutain fire, windstorm and extended coverage insurance with a mortgage clause on
<br />the buildings on said premises in the sum of ~ 25,000.00 If mortgagor fails to pay such taxes
<br />and assessments or procure such insurance, mortgagee may pay such tales and purchase such insurance
<br />and the. umaunt so advanced with interest at nine percent per annu.rn shalt be secured by this mortgage.
<br />]n cage of default in the payment of the principal sum ar any instalhuent thereof or of any interest
<br />thereon irizen the same shall become due ar in case of the non-payment of any taxes or assessments or of
<br />the failure_tq maintain insurance as herein provided, mortgagee ,nay at the option of mortgagee, with-
<br />out notice, at any -time during the continnanee of such default or breach, declare the whole debt secured
<br />by tLio mortgage to be immediately due and payable and ntay foreclose this mortgage.
<br />In the event of default in the performance of any of the terms and conditions of this mortgage or
<br />the note secured by it, the uwrtgagre shall be entitled to immediate possession of the property above de-
<br />scribed and alt the rents, revenue and income derived therefrom during such time as the mortgage in-
<br />debtedness-remains unpaid shall be applied by the mortgagee to-the payment of-the note and all other
<br />sums secured hereby after deduction of any necescar}' costs of collection.
