<br />SPECIAL WARRANTY DEED
<br />1. The City of Grand Island, Nebraska, by action of its
<br />City Council on September 28, 1982, enacted Ordinance Number
<br />6844, which directed the conveyance of the real estate described
<br />below and the manner and terms thereof.
<br />2. Ordinance Number 6844 was published in the G-rand Island
<br />Daily Independent according to law, and notice of such sale and
<br />the terms thereof were published in the Grand Island Daily
<br />Independent for three successive weeks on October 5, 12, 19,
<br />1982, all as required by §16-202 R.R.S. 1943.
<br />3. No remonstrance against such sale was filed with the
<br />City Council of the City of Grand Island, Nebraska, within thirty
<br />days of the passage and publication of Ordinance Number 6844.
<br />4. Section 5 of Ordinance Number 6844 provides that if no
<br />remonstrance be filed against such conveyance, the Mayor and City
<br />Clerk shall make, execute and deliver to the Grantee, a Special
<br />Warranty Deed for said real estate, and the execution of such
<br />Deed is hereby authorized without further action on behalf of the
<br />City Council.
<br />NOW, THEREFORE, the City of Grand Island, Nebraska, a
<br />municipal corporation in Hall County, Nebraska, as Grantor, in
<br />consideration of One Dollar---t$1.00)---received from Grantee,
<br />does hereby grant, bar-gain, sell, convey, and confirm unto
<br />DARYL EUGENE BARTLETT and DORIS LEE BARTLETT,
<br />hus-band and wife, as joint tenants and not as tenants in common,
<br />herein called the Grantee, whether one or more, the
<br />following-described real property in Hall County, Nebraska:
<br />Lot Four t4), Block Eighteen (18), Original Town,
<br />now City of Grand Island, Hall County, Nebraska,
<br />hereinaf to r referred to as the premises, to have and to hold the
<br />above-described premises unto the Grantee and to Grantee's heirs
<br />and assigns forever, so long as the Grantee gerforms all of the
<br />covenants and obligations contained in ~6. of the "Agreement for
<br />Purchase of Real Estate" recorded as Document Number $~- coy,~by in
<br />the Register of Deeds Office of Hall County, Nebraska.
<br />This Special Warranty Deed shall convey to Grantee an estaYa
<br />in fee simple determinable, and in the event of breach of any of
<br />the provisions of ~6. of the foregoing Agreement for Purchase of
<br />Real Estate, the possibility of reverter shall vest in the
<br />Grantor herein, the City of Grand Island, Nebraska.
<br />Grantor hereby covenants with Grantee and with Grantee's
<br />heirs-and assigns that Grantor is .lawfully seized of said
<br />premises; that they are free from encumbrance, except for the
<br />foregoing conditions: easements and restrictions of record; that
<br />Grantor has goad right and lawful authority to convey the same,
<br />subject to the foregoing conditions; and that Grantor warrants
<br />and will defend the title to said premises against the lawful
<br />claims of all persons whomsoever.
