r <br />C3~--~.~(1 ~ri~ir~. <br />r <br />KNO4d ALL MEN BY THESE PRESENTS: <br />AGREEMENT FOR SALE AND PURCHASE OF REAL ESTATE <br />The undersigned Seller does hereby sell to the under- <br />signed Buyer, the following described real estate for the <br />price and upon the terms and conditions herein set forth, <br />and the undersigned Buyer does hereby accept said terms and <br />conditions, agree to pay the purchase price, and to perform <br />the obligations of Buyer hereunder. <br />1. The Seller is: GERALD FREDERIKSEN and L. JUNE <br />FREDERIKSEN, husband and wife. <br />2. The Buyer is: WAYNE SMITH d/b/a S & S CONSTRUCTION. <br />3. The legal description of the real estate is: Lot <br />Four (4) and the east half of Lot Five (5); and Lot Six (6) <br />and the west half of Lot Five (5), all in Shady Lane Sub- <br />division, Hall County, Nebraska. <br />4. The purchase price is $10,500.00. <br />5. The purchase price shall be paid as follows: <br />A. Cash payment at the time of the execution <br />of this Agreement, receipt whereof is hereby <br />acknowledged by Seller. $ 5,250.00 <br />B. By Promissory Note in the form of <br />Exhibit A hereto, which is delivered at <br />the time of the execution of this <br />Agreement. $ 5,250.00 <br />$10,500.00 <br />6. Buyer shall be entitled to possession of the <br />property upon the closing of this transaction and the <br />closing shall be on execution of this Agreement. <br />7. Within ten days after the execution of this Agreement, <br />Seller shall furnish Buyer with a legible abstract of title, <br />extended to date by a registered abstracter, which abstract <br />shall show marketable title to the premises to be vested in <br />the Seller subject only to easements, restrictions, conditions <br />and encumbrances herein set forth. Within ten days after <br />Buyer's receipt of the abstract Buyer shall furnish Seller <br />with a written opinion from Buyer's attorney containing any <br />objections to Seller's title which Buyer claims to exist. <br />If Buyer finds any meritorious defects in Seller's title <br />then Seller shall have the option of canceling this Agreement <br />and refunding Buyer's downpayment in full or of correcting <br />and curing the defect in title. If Seller elects to cancel <br />this Agreement, Seller shall refund Buyer's payment hereunder <br />in full and this Agreement shall thereafter be of no further <br />force or effect cahatsoever. Zf Seller elects to cure and <br />correct the defect in title Seller shall have a reasonable <br />time within which so to do. <br />6. Seller shall pay (i) the Nebraska documentary <br />transfer tax and (ii) the general real estate taxes for the <br />year 1981 and ali prior years. Seller shall also credit <br />Buyer with 10/12ths cf the estimated 1982 general real <br />estate taxes estimated upon the general real estate taxes <br />for 1981. <br />9. Seller shall pay ali special tax assessments <br />against this property up tc Closing Date, except ~r the <br />following which Buyer hereby agrees to assume anc, :y, to- <br />wit: Nane. <br />-l- <br />
