<br />AFFIDAVIT
<br />STATE OF NEBRASKA, COUNTY OF HALL:
<br />Under oath, Robert B. Miller declares:
<br />1. He is the owner of the following described real estate situated
<br />in Hall County, Nebraska:
<br />All of the Southerly One Third (1/3) of Lots One (1) and
<br />Two (2) in Block Thirty-Nine (39) in the Original Town,
<br />now City, of Grand Island, Hall County, Nebraska as
<br />surveyed, platted and recorded,
<br />and
<br />A parcel of land in Lots One (1) and Two (2), Block
<br />Thirty-Nine {39), Original Town, now City, of Grand
<br />Island, Hall County, Nebraska, more accurately described
<br />as the North Forty-r^our (N 44') Feet of the South Eighty-
<br />Eight (S 88') Feet of said Lots One (1) and Two (2),
<br />Block Thirty-Nine (39), except the North Twenty-Two
<br />(N 22') Feet of the South Eighty-Eight (S 88') Feet of
<br />Lot One (1) and the North Twenty-Two (N 22') Feet of the
<br />East Five {E 5') Feet of the South Eighty-Eight (S 88')
<br />of Lot Two (2), as surveyed, platted and recorded.
<br />2. Affiant is not one and the same person as "Robert Miller" who
<br />was defendant in an action entitled "Daniel Case, Plaintiff, vs.
<br />Robert Miller, Defendant," Case No. SC5-151, in the Small Claims
<br />Court of Hall County, Nebraska, in which a Judgment was entered on
<br />October 28, 1980, in favor of the plaintiff, Daniel Case, against
<br />the defendant, Robert Miller, for the sum of $318.38 with interest
<br />from date of Judgment and costs taxed in the amount of $5.00.
<br />3. The Judgment Transcript filed in the District Court of Hall
<br />County, Nebraska, Case No. 3282, in the case of Daniel Case,
<br />Plaintiff, v. Robert Miller, Defendant, in favor of the plaintiff
<br />and against the defendant, Robert i~7iller, in the amount of $318.38
<br />with interest from date of Judgment and costs taxed to the defendant
<br />in the amount of $5.00, is not a judgment lien against affiant's
<br />real estate described in this Affidavit because affiant, Robert B.
<br />Miller, is not .one and the same person as Robert Miller, defendant
<br />in Case No. SC5-1S1 in the Small Claims Court of Hall County,
<br />Nebraska, in which "Robert Miiler" was the defendant.
