<br />THIS MOR2GAGE is made this ,~~1~ day of ryeVE~MQ,E 1982, between the
<br />Mortgagors, Ricky L. Triplett an~'J'acqu-eline K. Triplett, hus nd and wife, each in
<br />their own right and as spouse of the other, hereinafter called "Borrowers", of Hall
<br />County, and State of Nebraska, and the Mortgagees, James H. Moore and Dorothy J. Moore,
<br />husband arxl wife, as Joint Tenants with rights of survivorship, and not as tenants in
<br />common, whose address is I04 East 14th Streets Kearnex, Nebraska ,hereinafter
<br />called "Lenders".
<br />WHEREAS, Borrowers, are indebted to Lenders, in the principal sum of Thirty-nine
<br />Thousand Six Hundred and Nine nine ($39 699.00 DOLLARS, which indebtedness is
<br />evi a prom ssory note o Borrowers, ereinafter called "Note", dated
<br />Iy ~/ /~ Z payable on demand;
<br />TO SECURE LENDERS (a) the repayment of the indebtedness evidenced by the Note,
<br />advanced in accordance herewith to peotect the security of this Mortgage, and the
<br />performance of the covenants and agreements of Borrowers herein contained, and {b) the-
<br />- repayment of any future advances, made to Borrowers by Lenders, Borrowers do hereby
<br />rtartgage, grant and convey to Lenders the following described property located in the
<br />County of Hall, State of Nebraska:
<br />Lot Two (2) in Block (2) in West North Lawn Second Addition to the
<br />City of Woad River, Hall County, Nebraska.
<br />which has the address of 1403 Dodd St., Wood River, Nebraska 68883 (herein "Property
<br />Address');
<br />Together with all the improvements now or hereafter erected on the property, and
<br />all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and
<br />profits, water, water rights, and water stock, and all fixtures now or hereafter
<br />attached to the property, all of which, including replacements and additions thereto,
<br />shall be deemed to be and remain a part of the property covered by this Mortgage; and
<br />all of the foregoing, are herein referred to as the "Property".
<br />Borrowers ~venant that Borrowers are lawfully seised of the estate hereby
<br />conveyed and has the right to mortgage, grant and convey the Property, that the
<br />Property is unencumbered, and that Borrowers will warrant and defend generally the
<br />title to the Property against all claims and demands, subject to any declarations,
<br />easements or restrictions of record.
<br />Borrowers covenant and agree and agree as follows:
<br />1. Borrowers shall promptly pay on demand of Lenders, the principal and interest on
<br />the indebtedness evidenced by the Note, and any Future Advances secured by this
<br />Mortgage.
<br />2. Borrowers shall pay all taxes and assessments levied upon said real estate, and
<br />all other taxes, levies and assessments levied upon this mortgage oc the Note which
<br />this Mortgage is given to secure, before the same becomes delinquent, and keep the
<br />buildings on said premises insured against loss by_~ire, and hazards included within
<br />the- ter~~;"extended coverage" for the sum of $ r ~t loss, if any, payable to the
<br />said Lamers.
<br />,3. Harrowers shall keep the Property in good repair and -shall not commit waste or
<br />permit impairment or deterioration of the Property.
<br />'IT IS FURTHER AGREED (1) that if said Borrowers shall fail to pay such taxes or
<br />procure such. insurance, the Lerxiers may pay such taxes and procure such insurance; and
<br />the soon advanced, with interest at ~r~ per cent shall be paid by said Borro~rs,
<br />and this mortgage shall stand as security for the same. (2) That a failure to comply
<br />with any of the foregoing agreements, shall cause the whole sum of money herein
<br />secured, together with advancements made, to become due and collectible at once at the
<br />option of Lenders. •~
