<br />AGREEMENT WITH REAL ESTATE CONTRACT SELLERS AND BUYERS
<br />WHEREAS , GCxII1IE L. Fb~BEIflS(JN and > ~~ ,
<br />husband and wife, (hereinafter called "sellers"~ have sold to AIIIHUft L.
<br />KIRR and DESJJRIS C. KIRK husband and wife,
<br />(hereinafter called "buyers"), under the terms of a certain real estate
<br />iastall.ment contract, the following described property situated in the
<br />State of Nebraska, County of Hal-1 co wit:
<br />24xe Nortta~est Quarter (Nf~a) and the West Half of the Norths~st Quarter
<br />(V,sgNEa), all in Section Sixteen (16} , Township Twelee t12}, North,
<br />Range Eleven (11},-West of the 6th P. M.
<br />(The Purchase Agreanazt describgl herein was exeazted by the named Buyers

<br /> for the sum of Twenty Four Thousand cellars ($24,000.) said agreement
<br /> being dated, executed and acknowledged on March S, 1968 acel
<br /> WHEREAS, the buyers gropose to obtain a loan in an amount not to exceed
<br /> Cne Hundre3 Seventy ------- Dollars f$170,000.00 }from
<br /> the United S-rates of America, acting through the Farmers Hame Administration,
<br /> United Statea Department of Agriculture, and which property will be mortgaged
<br /> to the Government to the extent o€ the buyers' interest as security in
<br /> connection with said loan,
<br /> NOW-, THEREFORE, in consideration of the foregoing, the sellers or
<br /> their representatives, agree that they will comply with the terms of said
<br /> contract except as modified hereby and that itt the event of default on the
<br /> part of buyers under said contract, sellers .will. judicially_€oreclase the
<br /> same-and-seek deficiency judgment if necessa~s~9~^med ~11~€aro any other
<br /> remedy accorded to them by said contract or-b °1tnr. Thy°~~l:lers or their

<br /> intereai under the above-mentioned real estate contract, In the event that
<br /> the sellers, or their representatives, determine that judicial foreclosure
<br /> under the real estate contract is necessary to protect their interest, it
<br /> is hereby agreed that the State Director, Farmers Home Administration, Lincoln,
<br /> Nebraska, will be provided thirty (30) days written notice prior to such action, G yiS.`
