<br />THIS MORTGAGE, made and executed this 30th day of September ~ A.p
<br />i9 82 by and bettreen Michael v. Wright and Susan M, Wright, husband and wife
<br />of the County of I3a11 and State of Pebraska, party of the first part
<br />hereinafter called the ttortoagor and the Secretary of the Department of Housing and
<br />Urbam Development
<br />party of the second part, hereinafter called the Mortgagee.
<br />:'JITNESSETH: That the said Mortgagor, is justly indebted to th rtgagee in the

<br />which principal sum will not exceed an amount computed under the terms of the Plate
<br />executed by said Mortgagor on sentember 30 1982 with interest, ~in

<br />assigns the following described real estate situated in the County of xa11
<br />State of PtebraSkd, to wit Lot Sixteen {161, in Castle Estates, Subdivision,
<br />Hall County, Nebraska.
<br />TO HAVE AtJD TO HOLd the premises above described, with all the appurtenances
<br />- thereunto belonging and including all heating, plumbing and lighting fixtures and equip-
<br />merit Hato or hereafter attached to or used in connection with said real estate unto the
<br />P•fortgagee, and to its successors and assigns, forever. The fortgagor represents to, and
<br />covenants with, the Mortgagee, that the Mortgagor has good right to sell and convey said
<br />premises; that they are feee from encumbrance, except for an FHA first mortgage; and that
<br />the Flortgagor will o~arrant end defend the same agaihst the lawful Claims of all persons-
<br />whomsoever; and the said Mortgagor. hereby relinquishes all rights of homestead, and ail
<br />marital rights,.either in late or in-equity; and all other contingent interests of the
<br />tortgagor in and to the above-described premises, the intention being to convey hereby an
<br />absolute title, in fee simple,.including all rights of homestead, and other rights and-
<br />interests as aforesaid.
<br />PROUIDEO ALblAYS, and these presents ar•e executed and delivered upon the following
<br />conditions, to't•Jit:
<br />The tortgagor agrees to pay to the Mor gagee, or order, the principal sum of one Hundred
<br />Eighteen Thousand Eight Hundred and No/100ths-------------~ollarS ($ 118,800.00--- - )
<br />with interest as provided in the Vote dated September 30, 198~nd executed. by t4ortgaaor°
<br />The Mortgagor in order more fully xo protect the security bf this Mortgage, agrees:`
<br />1. Tfiat he twill pay the ihdebtedness, as hereinbefore provided. Privilege is
<br />reserved to pay the debt in whole,'or in an amount equal to one or more mpnthly payments
<br />on 'the principal that<are next due on the note, on-the first day of any morth prior to'
<br />maturity: Provided, however, That vrritten notice of an'intentian'to exercise such privilege
<br />is given at_ieast .thirty (30) days prior to prepayment.
<br />2. That the Portgagor will pay ground rents, taxes, assessments, water rates, and
<br />other governmental. or-municipal charges, fines, or'impositions, for which provision has
<br />not been made hereinbefore, and in default thereof the Mortgagee may pay the same; and that
<br />the tortgagor will promptly deliver the official receipts therefor: to the P•fortgagee.
<br />3. The lortgagor idill pay all taxes which may be levied upon the Mortgagee's
<br />interest in ,aid real estate and improvements, and which may be levied upon this mortgage
<br />or the debt secured hereby (out only to the extent that such is not prohib5ted by law and
<br />only to the extent that such wi71 not make this loan usurious), but excluding any ihcome
<br />tax; State or Federal, imposed qn t-fortgagee, and will file the official receipt showing
<br />such payment with the Mortgagee. Upon violation of this undertaking, or if the Mortgagor
<br />is prohibited by any law now or hereafter existing from paying the whole or any portion of
<br />the aforesaid'taxes, or upon the rendering of any court decree prohibiting the payment by
<br />the t•lortgagpr or any such-taxes, or if such law or decree provides that any amount so paid oy
<br />the Portgagor sna11 be credited on the mortgage debt, the tfiortganee shall have the right to
<br />give ninety days' o-rritten nptice to the owner of the mortgaged premises, requiring the
<br />l payment of the mortgage debt. If such notice 6e given, the said debt shall become due,
<br />payable and collectible at the expiration of said Ninety days.
