<br />ESCROW AGREEMENT
<br />Seller and Buyer in-the within Contract agree that the
<br />Warranty Deed provided for by the Contract has b~~n executed
<br />by Seller referred to below on the ~`,~''~° day of ~. `-', -'~, ` ,
<br />1981, and will be put..- in Bscrow a-long with the tra~t of 'Pitle
<br />with Cunningham:, B1~ckburh; VonSeggern, Livings}od, irancis s
<br />Riley, Attorneys at .Law, hereinafter referred>to as "Escrow
<br />Agent'", and will be delivered by Bscrow Agent to Buyer upon oom-
<br />pletion of all the payments and terms provided for by a certain
<br />Land Sale Contract °xecuted of even date herewith, which is
<br />attached to this Agreement.
<br />'':.This Agreement-shall bind and inure to the benefit of the
<br />successors, personal--representatives, heirs and assigns of the
<br />parties hereto. Escrow Agent signs below to evidence the receipt
<br />of the Warranty:'Deed and the Abstract deposited, and of its ices
<br />charged for acting as Escrow Agent. Escrow Agent hall be respon-
<br />sible for collecting the payments as outlined'in the-Land Sale
<br />Contract 'and remitting to Seller, the balance of the payments
<br />after.deductions of.>any nature as set`forth'in the Land Saie
<br />Contract.-
<br />Escrow Agent shall not'be liable for the exercise of discre-
<br />tion arising out of 'this Agreement in the absence-of .gross
<br />negligence or'bad faith on 'its part. $scrow-Agent also signs
<br />below to acknowledge receipt of the 3ocumehts`heren, and
<br />specifically to acknowledge receipt of the Warranty Deed`and
<br />Abstract wherein Seller grants, bargains, sel s and conveys unto
<br />Buyer, the following,_,described property.;
<br />Lot Six (6) in Block Four (4), Except the
<br />>Southerly Bight-Nine (89) feet thereof,
<br />in Park Place, An Addition to tha'City of
<br />Grand_Tsland, Ha1.l County,. .Nebraska.
<br />In-the event of any disagreement 'herein, Escrow Agent is-
<br />authorized to fle'approprate action .in any Court having juris-
<br />diction thereof for Declaratory Judgment, or'any szmilar'action
<br />as 'it may°elect. Seller andBu~'er jointly agree to compensate,
<br />Escrow Agent in the sum of $,~~J' `~-" for the formation
<br />and".duties of this Escrow Agreemeht. Seller and Buyer shall each
<br />pay one-half of the Escrow Fee. Escrow Agent acts hereunder in
<br />the sole duties'as described herein, and is not responsible or
<br />liable in any manner whatsoever far the sufficiency, correctness,'
<br />genuineness, or validity of any instrument deposited with-it, or
<br />with respect to the formal execution of the ame, or with the
<br />identity, authori*y, or right of any gersons".`executing ar deposit-
<br />ing the same.
<br />Escro:v ~igent shall not be required to take or be bound by
<br />notice of default of any person, or to take any action with respect
<br />to such default involving any expense ar liability, unless notice
<br />in writing is given, to a qualified employee'of Escrow Agent of
<br />such default by the undersigned, or any of them, axed unless Escrow
<br />Agent is indemnified ir, a manner satisfactory to it`or against.
<br />such expense or liability. Escrow Agent shall be protested in
<br />acting upon any notice, request,- waiver, consent, receipt sr
<br />other paper or document believed,'ny Escrow Agent to be genuino
<br />and to be signed by the proper: party or proper parties.
