<br />M & L PARTNERSHIP, herein called Grantor, in consideration oS
<br />One Thousand Five Hundred Dollars ($1,500.OfJl receipt of which is sere--br
<br />acknowledged„-hereby g rants. and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall 'County, Nebraska, herein called Grantee, a
<br />,permanent and perpetual easement and right-of-way to survey, construct,
<br />inspect, maintain, repair, replace, extend, remove, and operate thereon,
<br />watermains, valves, hydrants, and other appurtenances connected therewith, in,
<br />upon, above, along,-across, underneath, and through a sixteen (16:.0) foot wide
<br />tract of land located in part of,Lot Seven (7) of Roberts Subdivision, an
<br />addition to :the City'of Grand Island, Nebraska, the center line of he easement
<br />tract, being more particularly described as follows:
<br />Beginning on ther'North'line of Lot Seven (7)'of Roberts
<br />Subdivision', eight (8.0) feet West of the Northeast corner
<br />of the said Lot Seven (7 )'; thence Southerly parallel to the
<br />EasC line of the sai3 Lor Seven (7), a distance of six hundred
<br />eleven and nine tenths (611.9) feet; thence.deflecti:ng right:
<br />45°44' and running,Southwesterly, a distance of seventy two'
<br />and three tenths (72.3) feet, to a point on the Nor herly
<br />right-of-way line of the`Burlington Northern Railroad; said
<br />point being sixty one (61.0) feet Northwest of-the Southeast
<br />corner d.f the said`Lot Seven U) of Roberts Subdivision. The
<br />said"easement tract containing 0.25 acres more or less as
<br />shown on the plat dated b/10/$2, marked 'Exhibit "A",:.attached.
<br />hereto, and.: incorporated herein by reference,
<br />together with the following rights:
<br />Unrestricted ingress and egress to the above described tract of land fora
<br />installation,`maintenance, operation, and removal of such watermai.ns-and
<br />appurtenances..
<br />Such rights of ingress and egress .shall include all rights necessary for<,
<br />the full and complete use, occupation, and enjoyment of the easement herein'
<br />granted', including the right to excavate .and refi l ditches and'`trenches, to .:
<br />remove',. clear', and keep clear trees,. bushes, hedges, undergrowth, and other
<br />obstructions .interfering ~~i.th the surveying, construction, inspection,
<br />maintenance, repair, replacement, ..extension, removal, or operation of such
<br />watermai:ns and appurtenances. No structures, buildings, fences,, or ocher
<br />obstructions of any kind whatsoever, shall be allowed in, upon, above-, along,
<br />acrpss, underneath, or through. the easement herein granted.
