<br />THIS INSTRUMENT, made this ~ day of April 1982, between
<br />CHARLES FAIRBANKS, Sheriff of Hall County, Nebraska, and COMMERCIAL
<br />NATIONAL BANK AND TRUST COMPANY,
<br />WITNESSETH:
<br />That at a term of the District Court of the Eleventh Judicial
<br />District, State of Nebraska, in and for Hall County, held at the
<br />Courthouse in the City of Grand Island, in said County,. on the
<br />25th day of January 1982, it was among other things ordered',. ad-
<br />judged, and decreed by said Court in a certain cause pending in
<br />said Court between Corunercial National Bank and Trust Company,
<br />Plaintiff, and Darryl C. Wilhelmi and Harold Dale Parsons., et al.
<br />that the premises described as
<br />Lot Ten (10):,Holcomb's Highway Homes Subdivision.;
<br />in the City of Grand Island, Hall County, Nebraska,
<br />a Subdivision of a part of the Northeast Quarter
<br />of the Northeast Quarter (NE 1/4 NE 1/4) and part
<br />of Lot Four (4) Mainland, of Section Twenty Eight
<br />(.28), Township Eleven (11), North, Range Nine {9},
<br />West of the 6th P.M.
<br />be sold by or under the direction of the said Sheriff at public
<br />auction in Hall County, said Sheriff first giving public notice
<br />of the time and place of said sale according to law,. and
<br />-WHEREAS, the Sheriff. of Hall County, Nebraska, in pursuance
<br />of said order and decree, did. on the 29th day of March 1982, sold
<br />at public auction at the Courthouse in the City of Grand Island,
<br />- Ha11`County, Nebraska, the premises above described, having,irst
<br />given.. due legal notice of the time. and place of said sale for not
<br />less. than thirty (30) days immediately prior thereto in the Grand
<br />Island Independent, a legal newspaper printed and in general cir-
<br />culation in said County,. together with a dPSCription of the pre-
<br />mises as required by the order and decree, at which sale the
<br />premises were sold to the Plaintiff,-Commercial National Bank and
<br />Trust Company, for the sum of Forty Thousand Dollars ($40,000),
<br />that: being the highest sum bid therefore, and
<br />WI3EREAS, said sale: was afterwards, on the l9th day of April
<br />1482, duly examined and confirmed by said Court and the Sheriff
<br />was then. and there. ordered and directed by said Court to execute
<br />and deliver to said purchaser suitable conveyances of the premises
<br />so sold;
<br />NOW, 'THEREFORE, know all men by these presents, that I,
<br />Charles_Farbanks, Sheriff of Hail County, in order to carry into
<br />`effect the said sale and in pursuance of said decree., and by
<br />Yixtue of the statutes. in such cases made and provided, and in
<br />consideration of the premises, and of the sum of Forty Thousand
<br />Dollars ($40,000} paid. by the Plaintiff to me, receipt of which-
<br />is hereby ,acknowledged, as such Sheriff by these presents, do
<br />grant, convey, and bargain unto the Commercial National Bank and
<br />Trusf Company the: following described real estate, to-wit:

<br />X28}_, Township Eleven (li) , North, Range Nine (9) ,
<br />West of the 6th P.i+S.
