<br />CONSENT TO EASEMENTS
<br />WHEREAS, G & T TRADING COMPANX, a Minnesota corgoration
<br />{hereinafter "Grantee") has been conveyed certain real estate
<br />described on Exhibit "A" attached hereto and made a part hereof
<br />by this reference (herinafter °"Subject Property") by Grand Island
<br />Mall, Ltd., a Nebraska limited partnership (herinafter ("Grantor")
<br />by Werra Deed dated April 8, 1982, and rec,~riled as Document
<br />Number ~~, /+~L~~C--~ of the R„)~~}' Records of
<br />Hall County, ebraska, and,
<br />WHEREAS, in addition to the Subject Property; Grantor hats
<br />conveyed to Grantee by said Warranty Deed perpetual non-exclusive
<br />easements for ingress and egress over, upon and across the parking
<br />areas, driveways, exits and entrances of the shopping center owner
<br />by Grantor described on Exhibit '"B" attached hereto and made a
<br />part hereof by this reference (hereinafter "Easement Property");
<br />specifically, the driveway and curb cut adjacent to the southerly
<br />property line of the Subject Property as they presently exist,
<br />and,
<br />WHEREAS, CM ASSOCIATES, a Nebraska partnership {hereinafter
<br />"Mortgagee'") holds a mortgage on said Easement Property to
<br />secure the sum of $1,000,OO0.00, which mortgage, dated September 1,
<br />1.980, saes executed by Grand Island Mail, Ltd., a Nebraska
<br />limited partnership, whose addz•ess is 2208 North Webb Road,.
<br />Grand Island, Nebraska 68801, and recorded the 19th day of
<br />September, 1980, as Document Number 80-OG51$9 of the N~artgage
<br />Records of Hall County, Nebraska, and,
<br />WHEREAS, Grantee is requesting that mortgagee not interfere
<br />with, disturb or deny any of Grantee's, its successors° or assigns'
<br />rights or pr+.vileges as contained in said Warranty Deed.
<br />NOW, THEs'tEFORE, for good and valuable considerations. the
<br />undersigned Mortgagee agrees as follwws:
<br />L. Mortgagee does hereby covena*at and agree that it, its
<br />successors and assigns, shall not interfere with, distur3a or deny
<br />any of Grantee's., its successors'or assigns", rights or privileges
<br />as contained in said Gdaxranty Deed.
