<br />82°°~ s)0,14'S2 <br />RIDER <br />As further consideration for the conveyance of the <br />real estate by the Warranty Deed to which this Rider is <br />appended and made a part (hereinafter "Subject Property")', <br />Grantor and Grantee agree as follows: <br />1. Grantor covenants that no property presently owned <br />or hereafter acquired by Grantor within 1500 feet <br />of the Subject Property including but not limited <br />to the property described on Exhibit "B" attached <br />hereto and made a part hereof shall be so'ld`or <br />leased for use or occupancy for business whose. <br />primary business is the sale of fast food ham- <br />burge~s. This covenant on the part of the Grantor <br />shall be for a geriad of 20 years from the day the <br />Warranty Deed to which this Rider is appended is <br />placed of record. <br />2. Grantor hereby grants and eonveys onto Grantee a <br />perpetual, non-exclusive easement far vehicular <br />pedestrian ingress and egress to and from the <br />subject property to the adjacent shopping center <br />as described on Exhibit "B" attached hereto over, <br />upon and across the parking and driveways, exits <br />and entrances of such shopping center: <br />specifically, the driveway and curb cut adjacent <br />to the southerly property line as they presently <br />exist. <br />3. Grantor hereby covenants and agrees that all <br />portions of the shopping center as described on <br />Exhibit "B" attached hereto other than buildings <br />and landscaped areas, shall be paved and <br />maintained as parking areas and that Grantor shall <br />paint stripes thereon. indicating car parking <br />spaces and shai3 maintain the driveways, curbs and <br />sidewalks in good condition and repair, free of <br />al.i paper, debris, snow, ice and other refuse so <br />as to keep said axea in a neat, clean and orderly <br />condition. Grantor shall also maintain adequate <br />lighting for the parking area and driveways, which <br />lighting shah be kept on at night during Grantee's <br />business hours. <br />Grantee agrees to maintain and keep in repair its <br />driveways and parking areas. <br />4. Grantee may erect curbs, landscaping or bumper <br />stops on the Subject Praperi~y in ordeL to define <br />the boundaries of the Subject Property. However, <br />Grantor shall not erect any barriers to prohibit <br />cr prevent Grantee's non-exclusive easement rights <br />!'or access. Grantor hereby agrees that no building <br />ar obstruction will be built that will interfere <br />with or limit internal or external access between <br />the proposed improvements on the Subject Property <br />and all other buildings, and driveways in the <br />shopping center described in Exhibit "B" attached <br />hereto. However, Grantor shall not be obligated <br />to obtain Grantee's approval prior to changing any <br />plans for other buildings or selling any other <br />real estate owned by Grantor. <br />5. Grantor agrees that he has full right and author- <br />ity to grant an easement for access as outlined <br />above., and shall, if Grantee's title insurance <br />company requires to insure Grantee's easement <br />rights, agree to c:oaperate in obtaining nerx- <br />disturbance agreements, consents, wsicers and any <br />other agreements from lienholders, mortgagees, <br />tenants or any other party with sureriar r~:r.;ht:,. <br />
