<br />BANK O}' NEW YORK as Trustee for Popular Financial Services Mortgage/Pass Through Certificate
<br />Series #2006-D, by virtue of an Assignment dated May 28, 2008, and filed for record on June 16, 2008, as
<br />Instrument No. 2008w05171 of the Mortgage Records for Hall County, Nebraska. Said Deed of Trust was
<br />assigned by Assignee, THE BANK OF NEW YORK. as Trustee for P~pular Financial Services
<br />Mortgage/Pass Through Certificate Series #2006-D to THE BANK OF NEW YORK MELLON f/k/a
<br />THE BANK OF NEW YORK as successor by merger to JPMORGAN CHASE BANK, N.A., as Trustee
<br />for the benefit of the Certificateholders of Popular ABS, Inc. Mortgage Pass-Through Certificates
<br />Series 2006-D, by virtue of an Assignment dated January 21,2009 and recorded on February 19,2009 as
<br />Instrument No. 2009w01215 in the office of the Register of Deeds of Hall County, Nebraska. DONALD J.
<br />PAVELKA, JR. has been appointed as Successor Trustee, replacing TICOR TITLE INSURANCE
<br />COMPANY by virtue of a Substitution of Trustee filed for record in the Register of Deeds Office of Hall
<br />County, Nebraska. Said Deed of Trust conveys property legally described as follows:

<br />THE NORTHERLY TWELVE (12) FEET OF LOT FOUR (4) AND ALL OF LOT TWO
<br />(2), IN BLOCK TWENTY FOUR (24), IN UNIVERSITY PLACE, AN ADDITION TO
<br />THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA.

<br />Said default under the terms of the Deed of Trust has occurred by virtue ofthe non-payment of the installment
<br />payments due under the Deed of Trust. In addition, Trustors are hereby liable to the Successor Trustee,
<br />DONALD J. PAVELKA, JR., for all fees and costs associated with this default and recoverable pursuant to
<br />Nebraska statute S 76wlO12.

<br />By virtue of said default, Successor Trustee has determined to sell or cause to be sold the trust property
<br />to satisfy the obligation referred to above.
<br />
<br />The default may be cured within one (1) month of the filing of this Notice, and the obligation and
<br />Deed of Trust may be thereby reinstated as provided in 9 7 6w 1012.
