<br />TRUSTEE'S DEED
<br />
<br />This instrument, made this 5th day of February, 2009, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to
<br />a power of sale contained in that certain Deed of Trust recorded on March 22, 2004 as Instrument
<br />No. 0200402731 in the office of the Register of Deeds of Hall County, Nebraska, and LaSalle Bank
<br />National Association as Trustee for Certificateholders of EMC Mortgage Loan Trust 200S-B,
<br />Mortgage Pass-Through Certificates, Series 200S-B, hereinafter called "Grantee".
<br />
<br />WHEREAS, on March 27, 2008, Grantor, executed a Notice of Default pursuant to which
<br />notice was given to Mark Tracy, a single man, Trustor, under that certain Deed of Trust recorded on
<br />March 22, 2004 as Instrument No. 0200402731 in the office of the Register of Deeds of Hall
<br />County, Nebraska, covering that certain premises described as:
<br />
<br />THE SOUTHERLY 64 FEET OF THE WESTERL Y ONE-FOURTH OF THE
<br />NORTHERLY ONE-HALF OF BLOCK 10, IN WINDOLPHS ADDITION
<br />TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA,
<br />
<br />that a breach of an obligation for which the tnlst property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on March 31,2008, as Instrument No. 0200802636.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. ~76-1008.
<br />
<br />Subsequent thereto, beginning on December 22, 2008, Grantor caused to be published in
<br />The Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska,
<br />a Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 p.m. on February 4, 2009. Publication of such notice was
<br />made for five consecutive weeks on December 22, 2008, December 29, 2008, January 5, 2009,
<br />January 12,2009 and January 19,2009, the last publication being at least ten (10) days but not more
<br />than thirty (30) days prior to the date of sale.
<br />
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. ~76-1008.
<br />
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott attorney for Grantor, did at
<br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public
<br />auction, and did sell the same to Grantee for the sum of $28,494.00, it being the highest bidder
<br />therefor.
<br />
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $28,494.00 so bid
<br />and paid as aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its successors and
<br />assigns forever, all the estate, right, title and interest of which the said Mark Tracy, a single man,
<br />and his successors in interest, were seized or possessed at the time said Deed of Trust was given, or
<br />at any time thereafter, in and to the premises sold as aforesaid, to-wit:
