Andersen, being first duly sworn, deposes and says: <br /> <br />1. That the Affiant is the successor trustee under the terms and conditions of the Reuel <br />G. Andersen Trust Agreement dated July 20, 2005 (hereinafter referred to as the "said Trust"). <br /> <br />2. Following the death ofReuel G. Andersen on June 17, 2008, the settlor and initial <br />trustee of said Trust (a certified death certificate is attached, marked Exhibit "A", and made a part <br />hereof by this reference), and the signing by the Affiant of an Acceptance to Act as Successor Trustee <br />on July 2,2008 (an original of which is attached, marked Exhibit "B", and made a part hereof by this <br />reference), the Affiant became the successor trustee of said Trust. <br /> <br />3. That the Affiant remains the sole trustee of the said Trust as of this date. <br /> <br />4. That among the assets of the said Trust is the following described real property that <br />was transferred to the trustee of the said Trust by Warranty Deed dated July 20,2005, and recorded <br />in the Office of the Register of Deeds of Hall County, Nebraska, as Instrument No. 200506930: <br /> <br />An undivided one-half(Y2) interest in and to Lot 9, and the West 35 feet of <br />Lot 10, in Block 1, Bel-Air Addition to the City of Grand Island, Hall <br />County, Nebraska. <br /> <br />5. That pursuant to the terms of the said Trust and 930-3881(2) of the Nebraska Uniform <br />Trust Code, the trustee of the said Trust has the power, without court authorization, to acquire or <br />sell property, for cash or on credit, at public or private sale. <br /> <br />6.
