<br />TRUSTEE'S DEED
<br />
<br />KNOW ALL MEN BY THESE PRESENTS that WELLS FARGO BANK, N.A.
<br />SUCCESSOR BY MERGER TO THE OVERLAND NATIONAL BANK OF GRAND
<br />ISLAND is the Trustee under a Deed of Trust made and entered into on or about December 4, 1998,
<br />by and between RONALD A. RUSTMAN AND SUSAN E. RUSTMAN, HUSBAND AND
<br />WIFE, Trustors, and THE OVERLAND NATIONAL BANK OF GRAND ISLAND, as
<br />Beneficiary and Trustee. Said Deed of Trust was recorded on December 9, 1998 as Instrument No.
<br />98-112141 in the office of the Register of Deeds for Hall County, Nebraska. WELLS FARGO
<br />BANK, N.A. SUCCESSOR BY MERGER TO THE OVERLAND NATIONAL BANK OF
<br />GRAND ISLAND, Grantor, in consideration of the sum of Twenty-Nine Thousand Nine Hundred
<br />and 00/1 00 Dollars ($29,900,00) and other good and valuable consideration received from WELLS
<br />FARGO BANK, N.A., does hereby grant, bargain, sell, convey and confirm unto WELLS FARGO
<br />BANK, N.A. (hereinafter "Grantee" where appropriate), the following-described real property in
<br />Hall County, Nebraska, to wit:
<br />
<br />LOT 10, BLOCK 5, DALE ROUSH SECOND SUBDIVISION, CITY
<br />OF GRAND ISLAND, HALL COUNTY, NEBRASKA
<br />
<br />to have and to hold the above-described premises together with all tenements, hereditaments and
<br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br />
<br />1. That RONALD A. RUSTMAN AND SUSAN E. RUSTMAN, as Trustors, failed to pay to
<br />Beneficiary payments which were contractually due, and the Grantor, at the request of the
<br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest
<br />thereon at once immediately due and payable.
<br />
<br />2. That a Notice of Default as required by ~ 76-1006 was filed by Grantor on June 18,2008, as
<br />Instrument No. 200805247 in the office of the Register of Deeds of Hall COWlty, Nebraska.
<br />A copy of said Notice of Default was thereafter mailed to all parties entitled to notice,
<br />pursuant to said Deed of Trust and in compliance with ~ 76-1008, RRS, Nebraska.
<br />
<br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days
<br />after filing of the Notice of Default.
<br />
<br />4. That an Amended Notice of Trustee's Sale was filed by Grantor on October 7, 2008, as
<br />Instrument No, 200808552 in the office ofthe Register of Deeds of Hall County, Nebraska.
<br />A copy of said Notice of the time and place of the sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with ~ 76-1008, RRS.
<br />Nebraska.
<br />
<br />5. That Grantor as required by ~ 76-1007 published a Notice of Trustee's Sale to be held on
<br />November 18,2008, at 10:00 a.m. in the lower lobby of the Hall County Courthouse, 111
<br />West First Street, Grand Island, Nebraska. Said Notice was published in The Grand Island
<br />Independent, a legal newspaper of Grand Island, Hall County, Nebraska, once a week for five
<br />consecutive weeks commencing on October 4,2008, and ending November 1,2008. The last
<br />publication notice was at least ten days prior to the Trustee's Sale held on November 18,
<br />2008, and said sale was not later than 30 days after the last publication of notice,
<br />
<br />6, Attorney for Grantor conducted a sale of the real property at public auction on November 18,
