<br />(f) All utility deposits made to procure or maintain utility services to the Premises or
<br />the Improvements and any money, cash, negotiable instruments, documents of title, securities,
<br />deposit accounts or other cash equivalents, including interest or income earned thereon held by
<br />Beneficiary or Trustee under or in accordance with this Deed of Trust;
<br />
<br />(g) Any amounts in any escrow fund for the purposes of payment of taxes, insurance
<br />premiums or other Impositions in connection with the Trust Property;
<br />
<br />(h) The right, in the name and on behalf of Trustor, to appear in and defend any
<br />action or proceeding brought with respect to the Trust Property and to commence any action or
<br />proceeding to protect the interest of Trustee and Beneficiary in the Trust Property; and
<br />
<br />(i)
<br />inclusive.
<br />
<br />The products and proceeds of the property described in the above (a) through (h)
<br />
<br />TO HAVE AND TO HOLD the Trust Property upon and subject to the trusts and
<br />agreements hereinafter set forth:
<br />
<br />1. Secured Indebtedness. Without limiting the generality of the foregoing, this Deed
<br />of Trust is made for the purpose of securing the payment and performance of the following
<br />obligations, indebtedness, and liabilities: (a) all of the indebtedness, obligations and liabilities of
<br />Trustor pursuant to that certain Promissory Note from Trustor to Sarah Glade of even date
<br />herewith payable to the order of Sarah Glade, in the principal amount of FIVE HUNDRED
<br />THOUSAND AND 00/100 ($500,000.00), with interest, according to the terms thereof, and any
<br />other note given in substitution therefore or in modification, renewal, or extension thereof, in
<br />whole or in part (such note and all other notes given in substitution therefore or in modification,
<br />renewal, or extension thereof, in whole or in part, being hereinafter collectively called the "Sarah
<br />Glade Note"); (b) all of the indebtedness, obligations and liabilities of Trustor pursuant to that
<br />certain Promissory Note from Trustor to Carolyn Glade of even date herewith payable to the
<br />order of Carolyn Glade, in the principal amount of FIVE HUNDRED THOUSAND AND 00/100
<br />($500,000.00), with interest, according to the terms thereof, and any other note given in
<br />substitution therefore or in modification, renewal, or extension thereof, in whole or in part (such
<br />note and all other notes given in substitution therefore or in modification, renewal, or extension
<br />thereof, in whole or in part, being hereinafter collectively called the "Carolyn Glade Note"; the
<br />Sarah Glade Note and the Carolyn Glade are hereinafter individually referred to as the "Note");
<br />and (c) all indebtedness, liabilities, and obligations now or hereafter incurred or arising pursuant
<br />to the provisions of this Deed of Trust or any other instrument now or hereafter evidencing,
<br />securing and/or guarantying the above-described indebtedness or any part thereof.
<br />
<br />Collectively the indebtedness, obligations, and liabilities referred to herein are
<br />hereinafter sometimes called the "Debt."
<br />
<br />This Deed of Trust is made in consideration of Beneficiary's making the underlying loan
<br />to Trustor, and as an inducement to Beneficiary to make such loan.
<br />
<br />2. Warranty of Title. Trustor warrants that Trustor has good title to the Premises
<br />and has the right to mortgage, give, grant, bargain, sell, convey, confirm, pledge, assign,
<br />hypothecate, affect, collaterally assign, and grant a continuing security interest upon the same
<br />and that Trustor presently possesses an unencumbered fee simple estate in the Premises and
