<br />KNO\V ALL r"tEN BY THESE PRESENTS:

<br />THAT TierOne Bank, Trustee, in the exercise of the power of sale conferred upon it, does hereby
<br />execute and deliver this indenture,
<br />
<br />WITNESSETH THAT:
<br />
<br />WHEREAS, for a valuable consideration on November 18, 2004, Equestrian Meadows, L.L.C., a
<br />Nebraska limited liability company, Trustor, executed and delivered its Deed of Trust to TierOne Bank,
<br />as Trustee, and TierOne Bank, as Beneficiary, conveying the real estate hereinafter described in trust,
<br />with power of sale, in accordance with the terms and provisions set forth therein; that said Deed of Trust
<br />was thereafter recorded on November 19, 2004 in the office of the Register of Deeds of Hall County,
<br />Nebraska as Instrument No. 0200411280; and
<br />
<br />WHEREAS, the Trustor having defaulted in the payment of the indebtedness secured thereby
<br />and the Beneficiary having delivered to the Trustee a written declaration of default and having deposited
<br />with the Trustee all promissory notes; and
<br />
<br />WHEREAS, in compliance with Sec. 76.1006, Statutes of Nebraska, on October 21,2008, the
<br />Trustee filed a Notice of Default in the office of the Register of Deeds of Hall County, Nebraska, as
<br />Instrument No. 0200808881, which Notice fully complied with the requirements of said statute; and
<br />
<br />WHEREAS, in compliance with Sec. 76.1008, Statutes of Nebraska, on October 27, 2008, the
<br />Trustee mailed by certified mail, with postage prepaid, a copy of such Notice of Default with the
<br />recording date shown thereon, addressed to the following interested parties, to-wit:
