<br />WHEREAS, a voluntary Petition in Bankruptcy was filed by Robert W. Wagoner, hereinafter referred to as
<br />"Debtor", whether one or more, in the United States Bankruptcy Court for the District of Nebraska on the 29th day of
<br />August, 2006, and said Debtor was duly adjudged bankrupt on the lOth day of October, 2006; and
<br />
<br />WHEREAS, on the 30th day of August, 2006, by Order of said Court the undersigned was appointed Trustee of the
<br />estate and effects of said Debtor and is duly qualified and is now acting as such Trustee; and
<br />
<br />WHEREAS, the Trustee has given notice to creditors on the 21st day of March, 2007, of his intention to sell
<br />property at private sale; and
<br />
<br />WHEREAS, since no creditors have filed objections to said sale on or before April 16, 2007, with the Bankruptcy
<br />Clerk, this Trustee is hereby authorized to sell at private sale to James A. Wagoner and John A. Wagoner, as Tenants in
<br />Common, hereinafter referred to as "Buyer", whether one or more, for the amount of Ninety Thousand and No/IOO Dollars,
<br />($90,000.00), the following described property, to-wit:

<br />Debtor's 33.33% interest in Jackson Township, South Half (S l/2) of the South Half (Sl/2) of the Northeast
<br />Quarter (NEl/4) of Section Thirteen (13), Township Ten (10), Range Twelve (12), consisting of39.07 acres
<br />and the North Half (N1/2) of the Southeast Quarter (SEl/4) of Section Thirteen (13), Township Ten (10),
<br />Range Twelve (12) consisting of 78.53 acres, all in Hall County, Nebraska.
<br />
<br />NOW, THEREFORE, I, the undersigned Trustee in Bankruptcy of said Debtor, by virtue of the powers vested in me
<br />by the Bankruptcy Act and by virtue of said Notice and pursuant to said application and for other valuable consideration, do
<br />hereby grant, bargain, sell and convey to the said Buyer, its representatives, heirs and assigns forever, all my right, title and
<br />interest as such Trustee, subject to all encumbrances of record, the above described property.
<br />
<br />TO HA VE AND HOLD said property to the said Buyer, its representatives, heirs and assigns forever, as fully and
<br />completely as I, the undersigned as such Trustee, by virtue of said Notice confirming the sale thereof and of the Bankruptcy
<br />Act might or should sell and convey the same.
<br />
<br />The Trustee makes no representations or warranties herein and this Trustee's Deed is without recourse against said
<br />Trustee either individually or as such Trustee.

<br />be his voluntary act and deed as such Trustee for the purposes therein set forth.
