OA <br />°" - 005507 <br />to enforce the provisions of the Condominium Documents against the Associ- <br />ation. <br />(B) All attorneys' fees and other costs of enforcing the Condominium. <br />Documents, or decisions and resolutions of the Association, incurred by the <br />Assond;A -ion, or, in a proper case by AY agOa'4_ eved Owner, shall be assessed- <br />against the Owner found to be in violation, and such assessment shall become <br />a lien against such Owner's Condominium Unit and shall be enforced and <br />collected in the same manner as all other assessments provided for herein. <br />(C) The conveyance or encumbrance of a Condominium Unit shall be- <br />deemed to be made subject to all of the provisions of the Condominium Doeu- <br />ments, and shall be binding upon each grantee or Mortgagee without the <br />nwnaasifv nr innh,ninn n_f cnnh o itnce nrn�ri Ginn i_n_ fhn. incttn�mnnt- of nnnva_v - -- <br />ance or encumbrance. <br />22. Assessment for Common Expenses. <br />(A) All Owners, including Declarant shall be obligated to pay the <br />estimated assessments imposed by the Association to meet the Common <br />Expenses and reserves. The assessments for the expenses connected with <br />the maintenance, upkeep, and repair of Class "C" Property shall be divided' <br />among all of the Condominium Units according to the Unit's Allocated Interest <br />for assessments set out on Exhibit "E" )i. ein. The Class "A" Unit . Owners <br />shall be assessed for the expenses or l__ct_ed with ..saintenance, upkeep, and <br />repair of the Class "All Limited Property, as set out in Exhibit "F ". The <br />Class "B" Unit Owners shall be assessed for the maintenance, upkeep, and <br />repair of the Class "B"- Limited Property, as set out in Exhibit "G." <br />( °u) Annual assessments fur rile estimated Common Expenses shall be <br />in monthly installments and shall be due in advance on the first day <br />of each calendar month. The Association shall cause to be prepared and <br />delivered or mailed to each Owner at least once each year a payment state- <br />ment setting forth the estimated Common Expense assessments for the ensuing <br />year. <br />(C) In the event the ownership of a Condominium Unit, title to which is <br />derived from the Depin ~ nt _�;1.;_._>_ ces on _ -A - other ., th the firm aa� Of <br />the assessment period, the Common Expense assessments for that period will <br />be prorated. <br />(D) Common Expense assessments shall commence as to all Condominium <br />Units on the first day of the month following the conveyance of the first <br />Condominium Unit by Declarant. Common Expense assessments shall be based <br />upon the cash requirements deemed to be such aggregate sum as the Board <br />shall determine in its budget, at least thirty (30) days in advance of each <br />fiscal year, as necessary to provide for the payment of all estimated expenses <br />relating to or connected with the administration, maintenance, ownership, <br />repair, operation, addition, alteration, and improvement of the Common Ele- <br />ments, the Project, and personal property owned by the Association except as <br />otherwise provided. Said sum may include, but shall not be limited to, <br />expenses for management; premiums for insurance; landscaping and care of <br />grounds; common lighting and heating; repairs and renovations; trash, collec- <br />tion; wages; common water and sewer charges; legal and accounting fees; <br />-18- <br />a <br />ME' <br />
