<br />84 - 005506 <br /> <br />Exhibit "D" <br /> <br />r <br /> <br />NEBRASKA MORTGAGE <br /> <br />->A! ~ <br />! ~nl'! \.....- <br />This Mortgage made this 1:')- day of~ '" to.) = . 1984, between Devco <br /> <br />Investment Corporation, a Nebraska corporation ("Mortgagor") and Lincoln <br /> <br />Benefit Life Company, a Nebraska corporation ("Mortgagee"). <br /> <br />IN CONSIDERATION of Ninety-six Thousand One HundreEl Twenty-five <br />Dollars ($96,125) advanced by Mortgagee to Mortgagor who acknowledges <br />receipt of such sum which is evidenced by a First Promissory Note dated~June <br />15, 1984 ("the Note") which this Mortgage secures, the Mortgagor hereby <br />mortgages to the lvio:rtgagee the real property (!tpar1dng Lot") situated in- ,the <br />County of Hall, State of Nebraska, and described in Exhibit A which is <br />attached hereto and incorporated herein by this reference. Together with all <br />rents, easements, appurtenances, hereditaments, interests in adjoining. roads. <br />streets and alleys, improvements and buildings of any kind situated thereon <br />and all personal property that may integrally belong to or hereafter become <br />an integral part of such buildings and improvements to such real property <br />(collectively "the Property"), <br /> <br />Mortgagor covenants with Mortgag,>' and its successors in interest that <br />(1) Mortgagor holds title to the Pro", 1 in fee sL.ple and has lawfuL author- <br />ity to mortgage the same, (il) the o,.:,perty is free of liens and encumbrances <br />except easements and restrictions of record, tenants in possession. and as <br />stated above and (iii) Mortgagor will defend the Property against the lawful <br />claims of any person or entity. <br /> <br />1. PAYMENTS. Mortgagor shall promptly make all payments required <br />under the Note and any other instrument securing the Note. <br /> <br />2. TAXES. Mortgagor shall pay each installment of all taxes and spe- <br />cial assessments of every kind, now or hereafter levied and assessed against <br />the Property or any part thereof, before same become delinquent. without <br />notice or demand and shall provide Mortgagee with evidence of the payment of <br />s!!.!ne. Mortgagor shall pay all taxes and assessments which may be levied <br />upon Mortgagee's interest herein or upon the Mortgage or the debt secured <br />hereby without regard to any law that may be enacted imposing payment of <br />the whole or any part thereof upon the Mortgagee. <br /> <br />3. INSURANCE AND REPAIRS. Mortgagor shall maintain fire and <br />extended coverage insurance insurmg the improvements and buildings con- <br />stituting part of the Property for an amount equal to the actual cash value of <br />such improvements. exclusive of foundations. but in no event for an amount <br />less than the amount of the unpaid principal balance of the Note. Such <br />insurance policies shall contain a standard mortgage clause in favor of Mort~ <br />gagee and shall not be cancellable, terminable or modifiable without a ten (10) <br />day written notice to Mortgagee.
