<br />husband and wife, all being first duly sworn, jointly and severally, .deposeandsay:

<br />That they are the identical parties who executed and delivered that certain \vartanty
<br />Deed to Norwest Bank Grand Island, N,A., dated the llthday of October , 1984,
<br />conveying the following-described property: ---

<br />wts Four (4) and Five (5), Grand Island Industrial Foundation
<br />Subdivision, Hall County, Nebraska,
<br />
<br />That the aforesaid Deed was an absolute conveyance of the title to said premises to
<br />the Grantee named therein in effect, as well as in form, and was not and is not now
<br />intended as a mortgage, trust conveyance, or security of any kind, and that possession
<br />of said premises has been surrendered to the said Grantee; that the consideration in
<br />the aforesaid Deed was and is the release of personal liability fran the Promissory
<br />Nltes and Mortgages recorded as Docunents 79-008358 and 8<r006123; that the amount.of
<br />liability released equals or exceeds the value of the above-described real estate;
<br />and receipt of said consideration is hereby acknowledged by said Grantors.
<br />
<br />The aforesaid Deed of conveyance WiiS made ~" ,:lem as th.c. result of their request that
<br />the Grantee accept such Deed a~d was th0' tree and voluntary act; that at the time
<br />of naking said Deed they felt and still reel that the indebtedness above mentioned
<br />representing the principal, interest and advances under the terms of the Notes and
<br />Mortgages above referenced, represented a fair value of the property so deeded; that
<br />said Deed v~s not given as a preference against any other creditors; that at the
<br />time it was given there was no other person or persons, firms or corporations, other
<br />than the Grantee therein named interested, either directly or indirectly, in said
<br />premises; that they are solvent and have no other creditors whose rights would be
<br />prejudiced by such conveyance, and that they are not obligated upon any bond or other
<br />mortgage Hhereby any other lien has been created or exists agai.T\st the premises de-
<br />scribed in said Deed; and that in order to execute the aforesaid Deed to the Grantee
<br />therein, and in executing the same, they Here not acting under any misapprehension
<br />as to the effect thereof, or under any duress, undue influence, or misrepresentation
<br />by the Grantee or the agent or attorney of the Grantee in said Deed, and that it was
<br />their intention as Grantors in said Deed to convey and by said Deed did convey
<br />therein all their right, title, and interest, absolutely, in and to the premises in
<br />said Deed,
<br />
<br />This Affidavit 1S made for the protection and benefit of the aforesaid Grantee in
<br />said Deed, its successors and assigns, and all other parties hereafter deali~ with
