<br />84 - 00519(1 <br /> <br />r <br /> <br />PRIVATE EASEMENT <br /> <br />AGREEMENT <br /> <br />Grand Island Industrial Foundation as part of the <br />consideration for the deeds to Millard Warehouse, Grand <br />Island, and Delicious Foods Co. of even date herewith and to <br />each of which deeds this Private Easement Agreement is <br />Exhibit "A", does hereby create a private easement as follows: <br /> <br />1. The easement shall run over, along and upo~ a <br />tract of land eighty feet (80') in north-south width, the- <br />centerline of which is the common boundary between the tract <br />being conveyed to Millard Warehouse, Grand Island, and the <br />tract being conveyed to Delicious Foods Co. and which eighty <br />feet (80') of easement area shall run the entire length of <br />that common boundary, viz., 657.12 feet east and west. <br /> <br />2. The purpose of the easement is to provide a common <br />area ~~~ ingress and egress for pedestrians and vehicles of <br />all types to each of the tracts which it divides. <br /> <br />3. The easement shall be a private easement nota <br />public easement. The easement shail run with the land in <br />favor of the owners of record of th tracts which it divides <br />with each tract to be the domine;"~ 'CJ.:dct as.',,) the forty <br />feet (40') or the easem");:tt area ,:'v'er the other tract. and the <br />subservient tract as to the forty feet (40') of the easement <br />area on its side of the common boundary line. <br /> <br />4. The easement shall be perpetual unless sooner <br />amended, cancelled or released by mutual agreement reduced <br />to writing and recorded in the office of the Register of <br />Deeds of Hall County, Nebraska, by the then record owners of <br />all of the real estate which underlies the easement area. <br /> <br />5. The easement area shall be reserved to the use of <br />the record owners of the real estate which underlies the <br />easement area and to their respective invitees. but no <br />others. <br /> <br />6. Each owner of record shall be responsible for the <br />maintenance of that portion of the easement area on that <br />side of the centerline of the easement area and shall not <br />obstruct the same in any manner not constituting a reasonable <br />use of the common easement area without the prior written <br />agreement of each of the owners of record of the real estate <br />underlying the easement area. <br /> <br />Exhibit "8" to each of the following deeds: <br /> <br /> <br />(1) Grand Island Industrial Foundat.ion, Grantor - Millard \'1arehouse, <br />Grand Island, Grantee <br />(2) Grand Island Industrial Foundation.
